When the Case was called whereupon his Bond amounting to $500, was declared forfeited. A Case Bastardy in which Emily Shafer is plaintiff an Geo. T. Williams defendant has been trial in the county court for several Days past. The plaintiff states that in March. 1867. Williams visited her at the House Jerry Johnston in Covington where promises marriage he succeeded in seducing her. Criminal Intercourse was kept up Between them from March until november when she was found to ence Inu. He then seat her to the country to Board where she remained about eight weeks. She visited his fathers House after this remaining Only a few hours then returned to Covington went Over to Cincinnati a where in August 1868, at the commercial Hospital she was confined. Williams states that he was in the country at the time alleged in the warrant that Thoret was committed that he was not in Covington at the House Johnston in either october november 1867, the specific time fixed plaintiff that she became in cringe him. Dodsworth indicted for setting up a lottery judgment for $500 was rendered against the securities defendant. The grand jury reported indictments against the following persons John Hart assault Batter Charles la French grand larceny l. Berkely. Grand larceny Edward Moore assault Battery Michael Mcginnis robbery. French plead guilty to the indictment against him. And the jury fixed his punishment at two years confinement in the Penitentiary. At the same tripe a poor woman named Mary Pone was before the court charged with drunkenness. This woman in her testimony before judge Straub gave a pitiful account the cause that led to her intoxicating habits. 8he, some few years ago was very much bereaved with worldly matters sought to drive them from her mind resorting to the Glass. She was often arrested upon the streets in a beastly state intoxication carried to the station House. A Little daughter was always her Side taken with her. Some time since mrs. Pone was found in the same state together with her daughter was carried to the station House. This Mary Maguire seeing the helpless condition the Mother enticed the child to go w Ith hex become in inmate her House. The thought having a Good Home Fine clothes caused this in Nocent child to take the woman a advice she left her poor Mother in prison entered a House prostitution started in Ner career horrible shame damnation. The Mother the girl As soon As her term expired for Days weeks months searched for her daughter end finally found her in this mrs. Maguiree a Bouse sixth Street near Plum. Several times she tried to see her. But was prevented from so doing the not easily foiled although her past life bore heavily upon her mind the Mother could not give up her daughter she naturally waited in tend the House until she saw her daughter. Veslie spoke to her but the girl instead taking the Tadvick her Mother cursed her needed her not. Determined to get her daughter she swore out a warrant for the arrest 5irs. Susan Moore a coloured woman testified to a fire which broke out in the Magnolia at the lower Leved. She stated that she saw it first in the state room in a mattress in the lower berth there was no fire near she saw nobody the boat except Holmes the watch Man whom she saw at the door the state room Short time before. Charles Foster testified to the effect that Holmes the watchman was not Board so far As he could see at the time the fire. The Only persons he saw were the watchman Kilpatrick some coloured men. There might have been another watchman in the engine room. Mrs. Coleman testified that Holmes slept at her House the night the fire Wab not the boat. The Cincinnati Louisville mail line company. Judge Hagans disposed this Case. The suit was to recover the value a trunk its three chairs a Blanket averred to have been received the Steamer major Anderson a Louisville Kentucky the 10th november 1857, to transported to Cincinnati which were lost. An answer in the shape a general denial was filed afterwards the additional defense was set tip that the contract transportation was made sunday this being in violation off he sunday Laws Kentucky that the defendants a re therefore not liable. A demurrer was filed to this answer. Court the first answer denies the contract the second admits it implication but says it is null void. Both answers Are sworn to. This is rather an anomalous style pleading yet it is one which the code permits. The second defense however seems to an after thought. It does not appear from the pleadings that the contract was to Quot performed sunday that that was one its conditions. If it had been perhaps the defense would have been Complete the delivery the article to the boat the payment freight Money sunday does not itself constitute a cont aet in the absence the allegation an understanding to transport it. It must appear that the undertaking was entered into an that Day. For aught that appears from the pleadings the contract to transport was made the subsequent Day. If so the contract was Good sufficient proof the plaintiff would entitled to recover. There is no Bill lading. There is a Case in 97 mass. 45 Deckman is. Richmond the stud horse Case which clearly supports the conclusion announced. The demurrer should therefore he sustained. I a question As to a resulting Trust. Daniel Cunningham is. John Campbell administrator James Campbell deceased. Judge Hagans also decided this Case. The plaintiff claimed that certain real estate the title to which stood in the name James Campbell was purchased with his plaintiffs Money Tor his Benefit it had since been Flold he asked a judgment against the administrator for such portion the proceeds a remained in his hands. If there was in fact an investment Daniel Cunningham a Money in this property in pursuance an agreement understanding wit i Campbell made at before the Purchase the plaintiff is entitled to recover. This would an express Trust that agreement according to Miller is. Stock Ley 5, 195, a must Clear certain conclusive in proving not Only the existence the Trust that too at the time the conveyance but also As to its terms if Cunningham contributed the Purchase Money for the property the Legal title to which was conveyed to Campbell equity will recognize an implied Trust As resulting in favor the former.
