The Mississippi is As it were As badly blockaded As our railroads the Rush of freight in the direction of n. Being almost unparalleled. Over 8.000 tuns of freight Are now awaiting shipment at Cairo and the rates Are entirely under the control of the boats which Are said to be gradually advancing them to almost prohibitory figures. For instance the Nashville and Cairo packet co., which under existing contracts takes tobacco for n. At $6 50 per Hhd is charged $8, thus losing $1 50 per Hhd rather than refuse the freight. But. course the present arrangement involves too heavy a loss to be continued and of the tobacco raisers of the upper Cumberland have to pay higher rates before Long they will know where to place the blame. , feb. 20.�?River 20 feet and failing. During a storm a tree dead and partly decayed which stood on the Road bed and near the track of the Louisville and Nashville Railroad fell across the track by which the engine of the express train was thrown from the track and Filbern the Engineer killed. This is an action by the administer matrix to recover punitive damages under the set of March 1854 2 revised statutes 510. The evidence shows that from the condition of the tree and its proximity to the Road there had Long been apparent danger of its falling on the track that the danger and necessity of removing the tree might have been seen by Filbern As Well As by other employees engaged in running trains on the Road and. If seen it was a is duty to cause the removal of the tree or report the necessity of doing so to some Supe rior officer. The court instructed the jury in substance that it was the duty of the corporation to Kee the Road free from All objects and obstructions while might imperil the Safe transit of trains and that duty rested upon All its agents engaged upon the Road in running trains and especially the Roadma Ater and Section Bosses and if the jury believed that they knew or were notified that the tree was. From its condition subject to fall across the track and were apprised Long enough to have removed the peril and failed to do so such failure was wilful neglect within the meaning of the statute. If Filbern a death was caused by such neglect Aud could Ordinary care As a a employee of the defendant have avoided the consequences of such neglect the Law was for the plaintiff. If Fil Bern As employee by Ordinary care could Nave avoided the consequences of such neglect and failed to do so the jury should find for defendant. The jury found for the plaintiff $10,000 damages.
