10 county co defendants is almost certain to be raised in Philadelphia Federal Court i it was indicated today following thc language of a decision handed down yesterday by the Circuit Court of Appeals of the 9th District at San Francisco That court in receipt of an appeal jy a citizen from a District Court conviction of violation of the Volstead act announced that the enactment of the 21st Amendment and the era sure of the Volstead act from the statutes automatically prevented a court from proceeding further in a liquor case which still had not reached final judgement It was freely admitted in Philadel phia and Delaware county legal circles that the exact effect of this decision upon the McClure case is moot Neither Chet A Kcyes the special assistant to thc U S Attorney Gen eral
