Powers Orthe military letter from Alexander h. Step liens. Ivicin Ion va., Sopt 802. m. Calhoun Atlanta in dear sir your letter of tie 2#tli ult., to Hon. B. H. I Iii was sub Mitten to me by him a few Days ago for my views As to Tho proper answer to to to your several inquiries touching your Powers and duties in the office of civil governor of Atlanta to which Yon have been appointed by Gen. Bragg. I took the letter with Tho Promise to write to you fully upon the whole subject. This therefore is the object of my now writing to you. I regret the delay that has occurred in the fulfilment of my Promise. It has been occasioned by Tho press of other engagements and i now find my time too Short to write As fully As i could wish. The subject is one of great importance and this As Well As matters of a Kindred st it have Given me deep concern for some time past. I am not at All surprised at your being at a loss to know what your Powers and dailies arc in your new position and your inability to find. Anything in any written code of Laws to enlighten you upon them. The or nth is your office is unknown to the Law. Gen. Bragg had no authority for appointing you civil governor of Atlanta., ban i had and i had or have no More authority than any Street Walker in your City. L a apr his appointment therefore you can rightfully exercise no Moro Power than if the appointment had icon by a Street Walker. To Jive under a Constitution. That Constitution was for War As Well As peace. Under that Constitution to have civil Laws and military Laws Laws for the civil authorities find Laws tor the military. Tho first Aro to to found if the statutes at Large and Tho latter in the Iti Iles and articles of War. But in this country there is no such thing As martial Law and cannot to until the Constitution is set aside if such an evil Day shall Ever come upon us. All t in Law making Power the Confederate states government is vested in Congress. But Congress cannot do it must loss can any officer of the government either civil or military do it rightfully from the highest to the lowest. Con Gres stay in certain oases specified suspend the writ fail Abas Corpus tint this Bydie Means interiors w Ith the administration of Justice so Lar As to deprive any Arres of of his right to a speedy and Public trial by a jury after indictment amp a. It does not Lessen or weaken the right of such party to redress for an illegal arrest. It does not authorize arrests except upon Atli or affirmation upon probable cause. It Only secures the party beyond misadventure to appear in person to answer Tho charge and prevent any preliminary inquiry us to the. Formality or legality of his arrest. These Congress cannot impair by Law. The constitutional guarantees Are Alx ivc and beyond Tho reach or Power of Congress and much More if it could to above and beyond Tho Power of any officer of Tho government. Your appointment therefore in my opinion i simply a nullity. You. By Vir Knoof it possess no rightful authority and can a Perciso none. Tho order creating you civil governor of Atlanta was a most palpable usurpation. I speak of the Only in a Legal and constitutional ser be not of Tho motive that prompted it. But a Wise people jealous of Ali or rights would do Well to remember As Del Olmedo Well expressed it that a such acts so laudable when we Only consider the to Quot tiv of them make a breach at which tyranny will one Day enter a if quietly submitted to Long. Now then opinion is if any one be brought before you for punishment for Selling in Igor to a Soldier or any other allegation where there is no Law against it no Law passed by the proper Law making Power either Stato or Confederate and where As a matter of Courso you have no Legal or rightful authority to punish either by Fine corp really &c., you should simply make Elliis response to bring him or her As the Case May be one who that Yon have no jurisdiction of the matter complained of. A British Queen Anno was once urged by Tho emperor of Lussia to punish Ono of her officers tor what his majesty considered an net of indignity to Bis ambassador to her Enort though tie officer had violated no positive Law. Tho Queen s Momo Pablo reply was that a she could inflict no punishment upon any Tho meanest of her subjects unless warranted by the Law of Tho this is an example you might Well imitate. For i take it for granted that one will pretend that any general in command of our armies could Confer upon Yonor anybody greater Powers than the e ruling sort Ereign of England possesses in like cases under Sini ilor circumstances. Tho ease referred to in England gave Riso to a change of Tho Law. Alter that an was passed exempting foreign ministers from arrest so with As. In tie proper discipline of Tho army require that Trio Sale of liquor to a Soldier by a person not connected with the army should to prohibited which i do not Mear. Or question in the slightest degree let Tho prohibition to declared by Law passed by Congress wit the pain Sand penalties for a violation of Quot it with Tho and manner of trying the o tense Dainly set Forth. Until Tibia i done no one ins any authority to punish in such eases and any Ono who undertakes to do it is a. Transp ask or and a violator of Tho Law. Soldiers in service ask Well As the. Officers Are. Subject to the rules and articles of War and if they ohm Mitti by offence known to the the Litney Codo therein prescribed s. Trivia Ana punished not Ade for their Goy Bolus and articles of War or in other words if Tho military code for the government of Tho army is defective in Safiy respect it ought to to amond cd by Congress. There Alono Tho Power is vested. Neither generals nor their Provost marshals have any Power to Maleo alter or modify Laws either Radii tary or civil nor can they Dee Luro what shall be crimes either military or civil or establish any tribunal to punish what they May so declare. All these matters belong to Congress and i assure you in my Opin a nothing is More essential to Tho main. Tenancy and preservation of constitutional Liberty than that the military to Ever kept subordinate to the civil authorities. You then have my views hastily but pointedly Given. A. H. Stephens. Of tie South and Thoy Are his holy oracles in this Day of trial and tribulation. It is not necessary to counsel violent measures but it is not expected that any person will to permitted to accumulate leather and cloth for purposes of speculation. Tho Tsecos Sipics of the army Rise up like a Mountain and cannot and will not to overlooked. It was hoped at one time that to might obtain Winter supplies in Maryland. This Hope was born Ufler the army left Richmond and has now miserably perished. The government is unable to furnish the supplies for they Are not. To be in Tho country. If it had exorcised a Little foresight last Spring and summer when vessels wore running tie blockade of Calico Lii tin and oth army correspondence Savannah Republican. Our army us great deeds its trials us sufferings and us perils in the future. Winchester a sept. 26, 1862. My condition is such As to Render it impossible for me to rejoin tie army for Tho present. I was not prepared Lor the hardships exposures and tastings the tinny Lias encountered Ciuco it left the Tappahannock and like Many a seasoned campaigner have had to a a fall out by the indeed i can recall no parallel instance in history except Napoleons disastrous Retreat from Moscow where an army has Ever done More marching and fighting under such great disadvantages than Gen. Lee s has done Sinco it left the Bauks of James River. It proceeded directly to the line of the Tappahannock Aud moving out from that River it fought its Way to Tho Potomac crossed that Stream and moved Oil to Fredericktown and Hagerstown had a heavy engagement at Boone Boron and another at Crumpton below fought Quot the greatest pitched Battle of the War at Sharpsburg and then Roer Ossed the Potomac Back into Virginia. During All this time covering the full space of a month Tho troops relied but four Days and let it always to remembered to their Honor that of the men who performed this wonderful feat Quot one fifth of them were barefooted one half of them in rags and Tho whole of them half famished. The country from Tho Tappahannock to the Potomac had been visited by the enemy with fire and sword and our transportation was insufficient to Kepp the army supplied from so Distant a base As Gordons file and when the provision trains would overtake the army so pressing wore tie exigencies of their position the men Seldom had time to Cook. Their difficulties were increased by Tho fact that their cooking utensils in Many a ases had been lilt Hal Giitl As Wells a Yor Ryt Long Elso that would impede their movements. It was not unusual to Sec a company of starving men a barrel of flour distributed to them which it was utterly impossible for them to convert into bread with the Means and Tho time allowed to them. They could not procure even a piece of pm ainu or a Corn or flour sack upon which to work up their dough. Do you wonder then that there should be stragglers from Tho Rainy a that Bravo and True men should have fallen out of Lino from sheer exhaustion or in their efforts to obtain a Mouthful to eat along the Roadside ? or that Many seasoned Vei Orans the conquerors in Tho Valley at Richmond and Manassas should have succumbed to disease and been forced Back to the Hospital ? i look to hear a great outcry raised against Tho stragglers. Already Lazy cavalry men and Dainty staff officers and quartermasters who Are Moun Lod and can forage the country for something to eat Are condemning the weary private who notwithstanding his body May be covered with dust Aud perspiration and Quot his Leet with Sioux bruises is expected to trudge along under his Knapsack and Cartridge Box on an empty stomach and never to turn aside for a morsel of food to sustain his sinking limbs. Out upon such monstrous injustice 1 that there has been unnecessary stragglers is readily admitted hut in a Large majority of cases Tho men have Only to Point to their bleeding feet tattered garments and gaunt frames for an answer to the unjust charge. No army on this continent has Over accomplished As much or suffered As much As the army of Northern Virginia within the last three months. At no period during the first revolutionary War not even at Valley forget did our forefathers in arms encounter greater hardships or endure them More uncomplaining by. But great As have been the trials to which the army has been subjected Thoy Are hardly worthy to he named in comparison with the sufferings in store for it this Winter unless the people of the Confederate states everywhere and in whatever circumstances come to its immediate Relief. The men must have clothing and shoes this Winter. They must have something to cover them solves when sleeping and to protect themselves from the driving sleet and Snow storms when on duty. This must to done though our friends at Home should have to Wear Cotton and sit by the fire. The army in Virginia stands guard this Day As it will stand guard this Winter Over every Hearth Stone throughout the South. Tie ragged Sentinel who May Pace his weary rounds this Winter Oil the Bleak spurs of Tho Blue Ridge or along the Frozen valleys of the. Shenandoah Aud Tappahannock will also be your sentinels my in feud . It will to for you and your household that he Oneo tutors the Wrath of the tempest and the dangers of the night. To suffer end toils and Tillit for you too Bravo True hearted women of the South. Will you not clothe Bis nakedness then will you nut put shoes and stockings on hi8fuot?. Is it not enough that he has writ ton Down his patriotism in Crimson characters along tie Battle Road from tie Tappahannock to the of tonic Aud must this bleeding feet also impress their Mark of Fidelity upon the snows of the coming Winter 1-knew what your answer will be. God has spoken through the women or artices of like importance a partial at Leas. Supply at least of hats blankets shoes and Woollen goods might have been obtained from England. But foresight is a Quality of Tho mind that is. Seldom put. In practice in these Days. But whatever May be done by the people she Aid be Dono immediately. Not one moment can to lost that will not he marked As by Tho second hand of a watch with Tho pangs of a sufferer. Already the Hills and valleys in this High latitude have been visited by Frost and Tho nights Are uncomfortably Cool to the Man who sloops upon the ground. Come up then Nion and women of the South to this Sherod duty. Let nothing stand Between you and the performance of it. Nei Lior Pride nor pleasure nor personal ease and Comfort should withhold your hands from Tho holy work. The Supply of leather and Wool to All know is limited hut do Liat you can and All you can and As soon As you can. If you cannot Semi Woollen socks Send half Woollen or Cotton ones and so with under clothing Coats and pants. And if blankets Are tit to be had then substitute comforts of dyed stuffed with Cotton. Anything that will keep off the cold will be acceptable. Even the Speculator Ait extort Ioner might forego their gains Lor a season and unite in tins religions duty. If they neither clothe the naked nor feed the hungry who Are fighting for their Freedom and for their a a mines Aud property what right Havo they to expect anything but eternal damnation both from god and Man ? if the army of Virginia could March through the South just As it is ragged and almost Garofo Oteri and Fiat less Many of the men limping along and no quite Well of their wounds or sickness yet cheerful and no willing to abandon their places in the their clothes riddled with bails Ana to nor ban res Cuvo Rytti and dust of Battle and shot into tatters Many of them inscribed with Williamsburg a a a Sevon finos a a a Gaines Mill a a a Garnett a farm a a a front Royal a a a Mcdowell a a a Cedar run a and other victorious Fields if this army of veterans thus Clad and shod with tattered uniforms and banners could March from Richmond to the Mississippi it would produce a sensation that has no parallel in history since Poter the Hermit led his swelling hosts across to Tho Rescue of the holy scan Lphr. I do not write to create alarm or to pro due a sensation hut to arouse the people to a sense of the True condition of Tho army. I have yet to learn that anything is to to gained by suppressing Tho truth and leaving the army to suffer. If i mus withhold the truth when the necessities of the Sor Vico require it to be spoken i am quite ready to return Homo. There is nothing now from Tho front. It is reported that Jackson crossed tie River at Williamsport a in new Days ago to repair a Road which he might have occasion to use and then Ron Rod. I Seo nothing however to change the opinion heretofore of pressed Viz that the heavy work of Tho Campaign is Over unless Mcclellan should seek us on the South Side of the . This some Holove Public opinion at the North will compel him to do. It May be so though i doubt it. I had arrangements of procure full official lists of the casualties in Tho Georgia Alabama and Florida regiments As Well As some account of Tho performances of Tho troops from those Sta Les and regret that sickness should Havo prevented me from carrying them out. P. W. A. Gain in it. They Uro the damnedest rebels in the Wlizlo confederacy of rebels. Get out Madam you want some favor under that and out Sho had to go. The Sec Sli lady could it keep it you May be sure and it was before the Story was out. Another incident while our vessel was lying at Tho pickets Trio Yankee sentinels picked up a Little boy about six years who was playing near them and tried to induce him to Hurrah for Lincoln. A i a Hurrah and ill give you a i catching him up and suspending the Little fellow Over Tho canal they said a a Hur Rah for Lincoln or Well drop you a a drop and be damned a said Tho Little rebel and with a shout they set him Doton saying he was Robol Pluck to Ali crack Bono these two instances that i know of Are pretty fair specimens of tie Union feeling there. A deadly hatred for their Yankoos riders and tyrants Burns in Tho hearts of old and Young men women and children with few exceptions to the Rule. Correspondence of the Savannah Republican. Further from Sharps org and Shenard Slown. Future movements of tiie twi armies Winchester va., sept 2d, 1862. A surgeon of one of Tho Louisiana regiments who was wounded and left behind at Sharpsburg arrived hero last night and brings some interesting information in regard to the late great that place. He says Tho enemy lost three generals killed and ten wounded. The names of the wounded to did not got but the killed Are generals Reno Mansfield and Williams. Tho Baltimore papers containing accounts of Tho Battle had been received and strange enough they do not claim a Victory but admit that the Federal loss was quite 20,000. They doubtless changed their tune when they Learned Tho confederates had withdrawn across the River. When you remember that to took Only a few Hundred prisoners you May form some idea of Tho terrible loss sustained by the enemy in killed and wounded As confessed by his own press. The surgeon through whom this information is obtained states Itiat the Federal army was in a condition approaching demoralization and lie thinks if to had renewed the fight an easy Victory would Havo been the certain result. To forgets however that our own army was not in As Good fighting condition As it height Shavo been. The want of Confidence in o lir currency among the people of Maryland and tie utter impossibility Ofstie implying Sueh an army As ours at a Point so far removed from its base Noj by Iowna trains alone constituted another Eloi Ireni i i of our part. The enemy moreover stood stances and with the material he had around him. It is safer to give our enemy credit for too much ability than too Little. _ _ a some additional Parl Clars Havo been received of Tho affair at Sheperd town Ford. It was a. P. Hill and not Jackson commanded on Tho occasion. It is said and this is confirmed by the surgeon Al Ludo to above that about 2,000 Federal infantry attempted to Cross after us and out of that number Only ninety lived to return. Such As wore not killed and drowned were captured. Those who were taken As Well As tie prisoners who foil into our bands at Sharpsburg have not been paroled but sent on towards Richmond. Among the latter it is said were several who wore captured at harpers Forry and paroled two Days before Tho Battle. If such to the Case there is but one course open to us and that is to hang Ivory one of Thorn. Tho heavy work of Tho Campaign is probably an end. Jackson May be Loit in this Valley but the greater portion of Tho Confederate army will it is thought., take up its position behind the Tappahannock preparatory to going into Winter quarters while the main body of Tho Federal army will return to Washington leaving a i. Vision at Fredericktown and another at Hagerstown. From the Tappahannock to Tho Potomac the country has been Laid waste. Corn wheat Hay Bacon hogs beef cattle and Milch cows were either destroyed or appropriated by Popoy a army and there 3 not food and forage enough in the country to meet Tho wants of too few inhabitants left behind. Mill houses thrashing Mao Hions manufacturing establishments wagons carriages and farming implements were Burnt or rendered useless Bridges were blown up horses and Stock killed or carried off and furniture and Phi vate libraries and papers wantonly Mulla ted or committed to flames. With these facts before him Tho Reader May form some adequate idea of the difficulties the army encountered on its March though this blasted wilderness and at Tho same Timo see How impossible it is for it to go into Winter quarters North of Tho Tappahannock. The condition of the people in the Valley of Tho Shenandoah where we now Are is som Whitt better though far from Good whilst the climate is More severe and Tho transportation of supplies wholly dependent upon wagons. Below the Tappahannock to would Havo two railways that from Richmond and that from Lynchburg which meet at Gonlon Viller but i must Stop. Though much bettor i write in no Little pain. P. W. A. Yew Orleans. R a a Yankee Letler writer gives Tho illustrations of the presence of a sentiment Iti Liat City of which Tbs a Northern papers have been indulging so largely 1 \ a a Tho Union feeling existing Thorey that they talk so much about does not cols for Butler says that even the worn on and Shii Dren Are the do hit rebels heeler set w?~&ti5 there has been but Little Union feeling disc. Played where Tuero was nothing gained. Self interest has Boon t he potent with his Back against Tho Blue Ridge through which there was but one Turnpike and Tubat easily defended so that if to Bud driven him from the Field to could not have pursued him with any Hope of inflicting additional injury this was not All. In our rear was Tho Potomac which is subject to heavy freshest at this period of the year and when they set in the River cases to to Fordable for the remainders of Tho fall and Winter. The night preceding a the Battle and the Day on which it was fought the weather presented All the appearances of an approaching equinoctial storm. These considerations doubtless had their inf Leoneo upon Tho mind of Gen. Lee in bringing him to the Resolution to conduct his army Back to Virginia. But it May be asked Why lie decided to make a stand at Sharpsburg it was done i sup pose to cover Tho operations at harpers ferry and to occupy a position where different and shattered wings of Tho army could to concentrated in Tho event of a general attack As Well As to be convenient to a Good Ford on the Potomac. It must to admitted however that Mcclellan had displayed unexpected Energy and coolness in his movements. Iio put his army in motion As soon As possible after we Eros Sod a into Maryland and moved boldly on in our track. At the time the main body of his forces Meneou stored our rear guard under d. H.
