Roy Downing head of the Waters Section of the Iowa conservation commission said that because of an unusual twist in state Law the Banks and Beds of Many Rivers and streams Are owned by private individuals. As a result Downing and assistant attorney general Clif Peterson said iowans using those Waters Are liable for trespass charges if they do not have permission of the property owners. Hie Complex and sometimes confusing situation stems from Iowa Law which classifies Rivers As a a meandered or meandered which in state Law differs from the geography. Cal definition of winding or curving Means the River bed and Bank to the Ordinary High water line is state owned property. A non meandered Stream refers to one in which the bed and Bank is privately owned. Peterson said the Issue has not been a squarely before the courts so there is still a great Deal of confusion As to what it he and Downing agreed a court test is the Only Way to establish the extent of the Law. A Case involving the Law did come up earlier this month when a Luther College chemistry professor George Knudson of Decorah was charged with criminal trespass after beaching his Canoe on private property and going fishing in the upper Iowa River. Although that Section of the River was classified As non meandered Knudson was acquitted because criminal trespass which must involve destroying or taking property could not be proved. An attorney general a opinion issued in 1966 upheld the Law that boaters and canoeists could be charged with trespassing if they use a non meandered Stream. The opinion said canoeists have the right to traverse streams Only to the extent that they Are meandered Peterson said Downing disagrees sharply with the opinion and said his contentions generally have been upheld by courts in other states. A i certainly done to feel As Long As canoeists Are on the water they should be subject to trespassing Quot he said. A personally i feel it was a very poor opinion. It did no to exactly get to the Point. Peterson said the situation is further confused by sections of the Iowa code which indicate that the Public owns the water in Rivers and streams. He pointed to the Iowa Waters act which says every member of the Public has the right to traverse Iowa Waters. He said that is the position Many canoeists Are taking. Peterson also said the 1966 attorney general s opinion seemed to suggest the legislature should act on this but they Haven to done it another confusing aspect Downing said is the fact that die word a a meandered never has Boon defined. He said the streams were classified by surveyors in the Early 1800s but they went Only part of the Way upstream and stopped. The Point where the surveyors stopped was marked and everything upstream was classified non meandered and everything before was tagged meandered. Quot they went farther upstream on some than they did others and i done to really know what their criteria was a Downing said. Quot no place in history is there an indication of Why they stopped at a specific Downing said he did not know How Many Miles of Rivers were classified under each category but said the mileage of non meandered streams was far More than the meandered. Isu Drake team up on new program for Law students under a new cooperative arrangement Between Drake University Des Moines and Iowa state University students can save time while earning a Law degree at one school and an advanced degree in political science at the other. The arrangement allows for trans Fer of credits Between courses taken at the Drake Law school and the political science department at Isu Marsha Armstrong 906 Murray drive is the first student from Iowa state to Complete the political science end and now plans to enrol in the Drake University Law school this fall Drake then isl taking the other route Samuel Skare of Des Moines and a native of Lincoln Iowa is working toward his political science degree in summer school at Isu after completing his first year of Law at Drake. The program will save time and extra work for Skare who had planned to finish Law school and then study for an advanced degree in political science. Technically Law school requirements take three years to Complete. Under the new arrangement a person May get a masters degree in political science As Well As the Law degree in about three and one half years. Under the cooperative program a student can Transfer 12 semester hours of Law credit at Drake toward the masters at Iowa state. Likewise an isl student May Transfer 15 Quarter hour credits in political science to apply toward the Drake Law degree. A ifs an extremely attractive arrangement for the student interested in going into new Federal programs Quot according to Daniel Zaffarano Dean of the graduate College at Iowa state. A with knowledge of both Law and political science the student can apply expertise in both areas to a Public service a besides the Basic Legal training this allows the lawyer to gain insight into some of the red tape and regulations involved in government service a John d. Scarlett Dean of the Drake Law school reported. Miss Armstrong who holds undergraduate degrees in French and russian from Iowa state took a Back door into the program. A i was working in the graduate College office and was handling the correspondence Between the two schools about setting up the program and i really got interested in it a she said. She has completed 33 hours at Iowa state with a straight a a Quot average and has passed one set of Oral examinations toward her masters degree. Fifteen of those hours can now be applied toward the 90 hours required for the Drake Law degree. Skare is following a More complicated pattern. He has completed his first year at Drake and one summer session nine hours at Isu. National guard responsibilities kept him out of the second summer session but he plans to return next summer while accomplishing some Quot doubling up time next Winter Quot i ii pick up 18 hours in the two summer sessions and with the 12 Transfer hours from Drake ill still have to pick up 12 hours next Winter and Spring Quot he said.
