A Clif ton Leroy Driskell faces a possible death sentence Fol lowing his conviction Friday in the frs degree murder of 11-year-old Kevin Tapp. A jury Here convicted Driskell Friday night and re commended execution. An Appeal of the death sentence is automatic. The 37-year-old Oklahoma City Bank examiner was convicted of killing the Enid youth last july 29 and dump big his body beside a Garfield county Road near Covington. A passing Motorist found the body the next morning. The prosecution contended during the trial that Driskell had a fixation for tying up Young boys. Prosecutors said Driskell picked up the youth sometime around . July 29 and dumped the body later that night. The defense tried to shift the blame to another Enid Man Glenwood Morrison whose son testified that mor Rison was a sex deviate. But prosecution rebuttal witnesses testified that they had investigated Morrison and had cleared him of any involvement in the Case. By Patti Byrd Capitol news Bureau Oklahoma City Industrial housing firms in the Ada area May get some Relief if the Bill sen. James Mcdaniel a Fitzhugh started work on sees legislative completion. Mcdaniel said he has a Bill that would Correct state Law governing the moving of pre built or partially built Homes. Industrial housing includes any pre built or partially built Structure designed to be a residence and is assembled or formed at a manufacturing facility. Mcdaniel said his Bill would take care of the Width limitation the state Law sets on the houses that have to be moved. Mcdaniel said that the Industrial housing firms in Oklahoma cannot get permits to move their structures if they exceed 14 feet in Width. He said older Homes can be moved without the limitations but the new ones cannot. Mcdaniel said one such firm in Stratford is having trouble getting the permits to move its pre built Homes to the Sites. In other Senate action Mcdaniel voted for the tax increase on natural Gas that goes to out of state users. The Bill which has now passed both houses would Levy a seven per cent tax on every cubic feet of natural Gas at the wellhead destined to leave the state. The Bill is a part of a package to constitutionally increase the amount of Money other states have to pay for Oklahoma s natural Gas. Right now oklahoman pay More for natural Gas in the state than people out of the state. Mcdaniel called the Bill a Revenue producer for Oklahoma. He said i think that when the program is finally initiated it will have credit clauses for Oklahoma he said he did t believe the tax increase would affect consumer Gas costs in Oklahoma. The state s lawmakers lined up on both sides of the Fence following Federal District judge Luther Bohanon s order to the corrections department to reduce the number of prison in mates in Oklahoma. The order directed the Mcalester prison with a population of to reduce its number to 800. The ruling also ordered the Mcalester and Granite penal facilities to accept no More prisoners until their populations Are reduced. Granite would have to drop from 685 to 450 in mates. Mcdaniel said that gov. David Boren s and att. Gen. Larry Derryberry s decision to Appeal the ruling is Correct. He said that during the Appeal Oklahoma has a Chance to find a solution to the problem. Mcdaniel called Bohanon s ruling a Bombshell but said Oklahoma has had ample warning that the ruling was coming. Mcdaniel said beginning with the Mcalester riot we have had warning after warning that such a Federal takeover was he said the legislature has been taking action about As fast As is mechanically Mcdaniel said the new medium Security prisons being constructed in Hominy and Lexington will help. He said the state owes inmates clean housing adequate food and medical Atten Tion but questioned anything beyond that. Rep. Lonnie Abbott Dada said his first impression of Bohanon s ruling was that the judicial system has taken Over Abbot said the state needs to put More Money into a vocational rehabilitation program for the convicts. Converse called the Federal court order premature be cause the state has two new prisons under construction. Abbott and Converse split their votes on the tag Reform Bill that received its final passage in the House last week. Abbott said Oklahoma needed the mail order option and the staggered Purchase basis the Bill provides. He said the deciding Factor in voting for the Bill was the fact the legislature would get an initiative petition for tag Reform. He said that would have been worse than what the legislature came up with. Abbott said he believed the Reform would make it easier to buy License tags and end the congestion of the traditional two month period of tag Purchase. Converse called the tag Bill a blow to county he said it is for certain tag agents will receive less Money for their work.
