steel industry the price increase it sought but stretched it out over a three month period Under a decision by the Cost of Living Council major steel producers will be permitted to raise the price of flat rolled steel by about a ton on Oct 1 and by about the same amount next Jan 1 Ten companies representing 70 per cent of the industry had sought to put the full increase into effect on Wednesday John Dunlap chairman of the council said the increase was stretched out to have a minimum impact on the economy Other council officials said the increase could result m raising the price of a toaster by one penny and of a new car by up to assuming the council permits the auto industry to pass along the higher price it must pay for steel Flat rolled steel accounts for about 40 per cent of the steel industry's output The price ranges now from to a ton and the increase permitted for Oct 1 amounts to 2.2 per cent to 4 per cent The January increase amounts to the same percentage Although the order applies to only the 10 firms which applied for permission to raise prices under Phase IV rales controls the nation's largest companies 26 other companies which also produce flat rolled steel be permitted to request and obtain price increases officials said As part of its order the council postponed consideration of any application to increase prices for steel products not covered by Monday's Attorney General Elliott L declined to give senators a report of what the FBI learned in wiretaps of some of Kissinger's aides Both Republican and Democratic members of the Senate Foreign Relations WASHINGTON U PI President Nixon a federal appeals court Monday to ignore the heat and excitement of an unprecedented political scandal and uphold the secrecy of his Watergate tapes against demands that would cripple the presidency Suggesting that he could not have ended the Vietnam war or opened new relations with China without secret tions the President's lawyers urged rejection as without precedent a lower court demand that the tapes be turned over for private judicial review The issue in this case is nothing less than the continued existence of the presidency as a functioning institution White House lawyers said in a brief filed with the U.S Circuit Court of Appeals Chief U.S District Judge John J Sirica who ordered Nixon to give him the tapes defended his decision in a brief charging that no one even a President the right to withhold evidence from a grand Jury the same time Watergate special prosecutor Archibald Cox asked the appeals court to vacate ruling and order the tapes to go directly to the grand iury Sirica failed to articulate the standards he considers proper for determining what evidence will be ordered produced to the grand jury and what evidence if any will be kept Cox said After receiving the round robin of briefs by Nixon Sirica and Cox the Appeals Court will hear oral arguments Tuesday in the historic constitutional battle over possession of the recordings of Nixon's conversations with former White House and campaign aides The appeals court denied a request by the Senate gate committee to participate in Tuesday's hearings so it could present arguments over executive privilege which it said neither the White House nor Cox had emphasized The committee contends ex- privilege would not apply in the tapes case if it could be shown there was a possibility Nixon himself en- gaged in criminal activity The court also denied a request by several consumer groups to present arguments at the hearing about the use of executive privilege
