and His Wife Give Testimony to His Behalf The defense in the Vaca murder trial occupied the afternoon session of the court Tuesday and tbp case went over until 10 oclock this Ing The defendant and his wife were the only witnesses in the courtroom Mrs Vaca she and her husband bad quarreled on the day the tragedy She also denied that he had ordered her out of the house and threatened her with an ax She said he had been drinking on that it ay Vacas testimony was unimportant save to bolster up the theory of the defense that he was in such a menial condition that he was irresponsible when he committed the bloody deed I do not remember was the answer to most material quest ions He ad mitted that he took several drinks that morning and gave a detailed statement of his movements up lo the lime I hat his memory lapsed from the effects of excessive drinking He had no recollection of the collision with the officers in fact did not become rational until the next day after he had been locked up in jail By stipulation all the court officers left at 3 oclock for Winters where the deposition of Rudolph Paul was taken The substance of his testimony was that some time lasl July he bor rowed Vacas gun and while he was out hunting Hi was prematurely dis charged The only apparent purpose of this testimony is to promote a the ory that the gun may have been acci dentally discharged
