Carey Case May Go Over Timer Court Vacation Although the ease of Reclamation District No 108 does no come up un til April Judge Hawkins made an order Monday afternoon the effect of which will be to restrict the num ber of issues Involved A few days ago a motion to strike out certain allega tions in the complaint was argued by William Devlin for the plaintiff and Stanley Moore for the defendants There were sixty or more paragraphs in the petition to strike out and the motion was grunted as to of the paragraphs In most instances the matter stricken out the court thinks raises issues that have no place in a condemnation but must be determined in other suits Among the things eliminated are the allegations in relation to the damages to lands other than the tracts through wbich the levee will pass damages to the Knights Landing ridge and the town of Knights Landing and the practica of the plans The principal issues therefore to he considered under the courts rul ing is the route chosen he one most compatible to the greatest public good and least private injury the value of the land that will be taken and dam age to land not taken by reason of Us severance and by of the con the levee The good faith of the trustees in adopting the plan may also be an issue While the court does not say so the inference is the allegations stricken out such as the damage to Knights Landing ami the ridge and the dam age that will result from backing the water tip on the lands of others out side the district raise issues that can only be determined by an injunction suit After of the arguments in
