   Woodland Daily Democrat (Newspaper) - November 2, 1909, Woodland, California                                MEETING OF CITY TRUSTEES The Bitter Contest Oner Street Work Renewed Motion That Is Ineffective Petitions for Arc Lights Re ferred to Committee The regular meeting of the city trus tees furnished another surprise Mon day evening and what promised to be a quiet session utterly devoid of anything out of the ordinary ended in a tempest and a renewal of the bitter contest that has been of all the proceedings iu relation to street improvement The routine business was dispatch ed with expedition all the proceedings were practically unanimous not a of had disturbed the equanimity of the board everybody Avas in an amiable and an early and peaceful adjournment was in sight until the regular order was completed There was not the slightest indica tion that a storm was brewing and it brake with such suddenness that we are constrained to believe that not a single member of the board antici pated that the session would end in a sensational renewal of the bitter contest over proposed plans of street improvement The trouble was precipitated by a suggestion made by Mayor Mitchell in relation to some work he thought ought to be done on Main street At a previous meeting the street committee was authorized to negotiate with Supervisor Scott to have the street from Walnut to Cemetery ave nue scarified leveled and rolled with the county steam roller Mayor Mitchell reported that Mr Scott had reported that It Is too late to do the work unless the grade Is sup ported by crushed rock He agreed to prepare the street and put on an ap plication of crushed rock for a ton the actual cost No charge would be made for the use of the roller The supervisor said he was willing to give the use of the roller for the dation of the country people who must travel to and from Woodland Mayor Judge Alberry and the district court account of Ones Superintendent Boulware reported the collection of for water It was ordered that two carloads of crushed rock be purchased for the purpose of leveling up all the cross ings The street committee was authorized to put in a culvert at the corner of North and First streets It was ordered that street sprinkler be kept oh for another month and when not engaged in sprinkling that he be required to haul gravel and repair streets Ordinance No 187 was read the first time It provides tor opening and ex tending Cleveland street from Main to Elliott street to describe the improve ment and the land to be taken to spe boundaries to be assessed It was referred to the ordinance committee and the city attorney A petition lor the installation of an arc light at the junction of Second and streets was also a peti tion for one to be Installed at the in of and Kim streets The petitions were referred to the street committee The sewer was Instructed to enquire as to the best method of connecting the property on Main street with the sewer It was ordered that the taxes on all churches that have made the required affidavits be canceled They are the Baptist German M i3 M E South Christian and the Catholic city attorney was directed to with the officials of cities and towns that have parks and get some information in relation to the methods out parks MRS H MCE Supreme Court Reverses Lower Courts Decisions The Case Will Have an Important Bearing Upon San Francisco Graft Prosecution The supreme court has handed down an opinion reversing the decisions of Mitchell insisted that the work ought to he done for tho accommodation of people who trade in Woodland There was a momentary silence broken by Trustee White with the re mark that the people on that street wanted the work done provided some one else pays for it Trustee Curson said if this work is so necessary why not do it according to the plans pre pared by Mr Ashley The mayor replied that it is because the board had neglected certain requirements The supervisors had not been asked to provide in the tax levy for money to the ex pense of macadamizing the streets on four sides of the courthouse square and no provision had been made in the tax levy for funds to do such work around the city library As the law requires that all the money shall be collected and in the treasury before the contract is let it would be im possible to proceed with the work and comply with the law He was opposed to any further expenditure of money on plans that must ultimately fail After several heated passages be tween the mayor and Trustee the latter called up the motion de at the first meeting in October which directed the city attorney to prepare the resolution to au the macadamizing of all the of appeal of the third district in the case of County of Yolo vs Halcyon Joyce In the case of People vs Mc Grew Mrs Joyce as official court re porter furnished Harry L Huston at that time district attorney a tran script of the proceedings A claim was presented to the county board of supervisors and paid Thereafter a Question was raised as to the legality of the demand District Attorney Anderson filed an action in the superior court to recover the amount of the claim Judge Alberry decided that the county could not be charged for a transcript of testimony in a criminal case except when the same was ordered by the superior court Mrs Joyce took an appeal to the district court of appeal which af firmed this decision Thereafter the supreme court granted a rehearing and now decides that Mrs Joyces claim wasa legal and valid one and that the county cannot recover The amount involved is about Mrs Joyce made the usual charge for her services and the only Question as to her right to the money depended upon the power of the district attorney to order the transcript The case will also have an important bearing upon the graft prosecution for the reason that it involves a construc tion of the provisions of the County streets mentioned in the engineers Government Act as to the power of port in accordance with his plans I the District Attorney to incur expenses The resolution was adopted by tho in the detection of crime and prose following vote Muegge of criminals
