Witnesses Testify That Frank Allens Reputation for Truth and Honesty ii Good When our Wednesdays report of tbe proceedings in the Johns note case closed G W Gregory waa still under He stated that he showed the note to his sister and Ur Hawkins on the 3d of 4th of June and that bis mother first saw it on the day o the petition for a partial distribution of the estate Ha does not recollect that he ever received a letter from Tandy Allen him to petition found on page 266 volume 2 in probate orders in which petition wai the of the court filed Jane 9 the endorsement on the claim filed the fame day the notice of motion oC J 0 Ball to vacate and set aaide the Older approving the act of the and the affidavit of Tandy Allen the order ot the court on Jane 12th denying the motion An objection was made by Mr Hiram Johnson The court over ruled the objection Judge Grant waa put on the stand and testified that no notice of or mo tion to set aside this last order allowing the claim had been served upon him was to in re gard to the which led up to and attended the making of the cited above This Judge did to the apparent satisfaction of the attorneys for both sides The court ordered an explained that he Iad not anybody of tbe exist ence of the note prior to the datee named because hie grandfather had re quested him not to do ao On re croas examination witness admitted that he could give no reason why he did not tell of the existence of the note ae soon as his grandfather died Mrs GeoW Gregory was the next witness In tbe early part ol July 1898 she was at home Bhe came to Woodland on the Her children came with her ber grandfather Mias Mary Gregory and her niece On the 7th of July middle of the afternoon husband of witness arrived from Her husband and his grandfather went into tbe house together Later the witness followed Htio found Mr Johna in the dining room and some writing material on a email Bland She asked who had been writing and Mr Johns replied George Mr Sacramento counsel as well argue this question The argument consumed the re mainder of the morning session and was participated in by Mr and Mr Hiram Johnson or contestants and Mr Grove L John son for the executors The court in effect decided that the order of the court refusing to vacate the order by which the allowance of the note as a claim the estate waa made and the failure of contest ante to
