Annie Lyon and Duncan vs the city of Grand Rapids The verdict in the case of Annie Lyon vs Rapids was for damages but was cut down by the trial judge to and costs and judgement for that amount was entered against the city In the case of Lydia Duncan judgment was secured for and costs Both cases were appealed to the supreme court by the city In reversing the judgement of the lower court ill the Duncan case the supreme court held against the city on every question presented but tound that the court iu its to the jury on one question of the special verdict In the case it was held that it was error under the complaint as drawn to introduce evidence as to the condition of the walk in question in the immediate vicinity and ou cither side of the hole into which the plaintiff stepped The
