Declares Too Drastic Action Would Impair Service Kill Jobs Washington D inter state commerce commission in a 7 o 3 decision Saturday held the gen ral railroad freight rate structure to be reasonable in the light of pres ent conditions and refused to order a blanket reduction as requested by arm lumber coal and other inter ests The commission asserted however that the decision must not be re as holding that all existing charges were fair and suggested the consider revision downward n rates on grain lumber and export coal Rate revisions must be continued without abatement to meet new con It said Rate peaks must be retained where justified and cut down where found The decision was on a petition filed last January by farm organiza tions the National Coal association and tho National Lumber Manufac association which said freight rates had been maintained at pros period levels while commodity prices dropped Still Relatively Higher The commission said that after allowance f or the recent upturn in commodity prices the freight rate level is still relatively higher than price level It held further that commodity prices alone were not the controlling factor in determining the reason ableness of rates that present rates as a whole were not depressing the volume of traffic or business of the country and that general rate re would not stimulate the aggregate volume of traffic by Mil road except so far as they would tend to recover traffic from com forms of transportation The majority of the commission said that net revenues of the car riers last year were only half that of the depression year of 1021 and that after making full allow ance for the recent upturn in the volume of traffic if rates in general were lowered as much as 10 per cent the net revenue In the near future would probably fall short of meet ing fixed charges by over Would Threaten Service By still further lowering the rev enues of the carriers the decision said a blanket cut would threaten the continuance of adequate rail road service and by preventing maintenance and other work would tend to increase unemployment With a general reduction in freight rates no greater than 10 per cent it continued unless there were a greater increase In traffic than now seems probable and unless large ad government aid were ex tended many more carriers would be forced into receivership or reor with consequent serious losses to investors in railroad securi ties among whom are many savings banks and life insurance companies Commission Dissents In a dissenting opinion Commis Altchison said the existing rate level constituted a violation of the interstate commerce acts pro visions prohibiting unjust and un reasonable rates and while the in recovery program presented countervailing tendencies it was not intended to cure maladjust ments and disparities In rates The successful consummation of the policies and plans now under way said calls for a rate structure better adapted to what the committees one studying Iowa governmental reorganization and the other the senate interim tax re vision committee are considering what tax revision measures to sub mit to the Iowa legislature in appointed a tri bunal of seven men to preserve in peace in the nation thru the recovery campaign Ho acted at the suggestion of the leaders of management and labor in an unprecedented peace time move by the men who keep industry going to maintain a national unity of effort for better days The proposal which came from the advisory boards of the national recovery administration was brought here in a dramatic night airplane trip by Hugh S Johnson the industrial administra tor Headed by Wagner Of importance to the recovery pro gram is the appeal to management and labor for industrial peace which has just been sent to me for ap proval said Mr Roosevelt in a statement announcing appointment of the tribunal headed Wagner Democrat of New York With compelling logic it calls upon every individual in both groups to avoid strikes lockouts or any ag action during the recovery program It is a document oh Samuel Gompers memorable wartime demand to preserve the status quo in labor in addition to the signature of the president of the American Federation of Labor it carries the signature of every great labor leader and every great industrial leader on the two advisory boards of the recovery administra tion It is an act of economic states manship I earnestly commend it to the public conscience Green on Board This joint appeal proposes the creation of a distinguished tribunal to pass promptly on any case or hardship or dispute that may arise from interpretation or application at the presidents reemployment agree ment The advantages of this recom are plain and I accept it and hereby appoint the men it pro poses whose names will carry their own commendation to the country The six members besides Senator Wagner are William Green dent of the American Federation of Labor Dr
