IN Prouty Says It Will Be Held Saturday as failed Exact Equality In Matter of Rates Is The Object of The Law Chicago July it be lawful to make an exchange of railroad transportation for advertising then lf would be lawful to do the same in every transaction and the railroad business might lawfully become one of barter and sale limited only by the demand In a decision handed down today by Judge Kohlsaat of the United States circuit court from which the above is the jurist enjoined the issu ance of transportation by the Chi cago Indianapolis Louisville rail way company to the publishers of thd magazine in exchange for advertising The decision was ren dered in a test case in which the fed eral authorities brought suitto pre vent the carrying out of a contract entered into between the railroad company and Munsey and company providing for the Issuance of trip tickets or mileage to the value of in consideration of certain ing space the publication of the magazine company The contract was be in violation of the Hep burn law The petition charges that the action of the railroad company in issuing such transportation accepts compensation for transportation greater or less or different from that named In the published rates The railroad company insisted that it received full money value based on the schedule of rates and mileage tickets issued and denied that It was committing a violation In passing upon the question of compensation the The question as to the value of the advertising is the contested one Question of Manifestly there can be no fixed price placed upon it The a Close Prouty said last night The a terrible beating convention will be held as were made called Saturday in Des Moines Yes there is going to be a republi can congressional convention In this city the coming Saturday It is true the members of the old Hull congressional committee Issued a proclamation calling off the conven tion But it is also true that notice has been issued by the friends of Judge Prouty that the effort to call oft the convention is without author ity and that it will be held Attention was called last night to the fact that the committee issued the call for the convention under date of June 20 On that date the committee which Issued the call terminated and new committee was elected by the county conventions held that day Raving expired it is pointed out the old committee cannot legally revoke the the convention under any j circumstances No arrests DRYS CONVENE Temporary Chairman Criticises of the Great Parties No Contested Delegations and Con Work l snort tions enter into the estimate of its worth It is therefore impossible to say what Its cash market value is ex cept by comparison with other ad rates It cannot be said that the evidence is conclusive or even convincing on this point If it is taken at its cash value why should the transportation be limited as fied In the contract If the magazine Is paying to the defendant why does it accept transportation both of less and different value than it would accept if it bought its tickets with money It seems fair to conclude that cither the advertising is of less than cash value or the advertisers are grossly imposed upon by the rail roads After citing several decisions ren dered in somewhat similar cases the judge says It will be noted that the contract does not require that the advertising must be furnished before the trans Is given and there Is no re striction upon the advertiser to call for his railroad only so far as earned In the mere matter of in terest the rate would be less and dif ferent from that which is published There is no mistaking the trend of the and construing powers Every new step is tending toward most rigid enforcement of the rule that requires exact equality in the matter of When by the Hepburn act the word different was added to the words greater or less it is not unfair to assume that congress in tended to make the law more explicit and more difficult to evade The plain Intention is to dose every avenue against discrimination It Is essential tc the spirit of the statute that tho value of transportation be fixed and It one person may pur chase It with advertising another with labor and another with produce the value of which is a matter agreement between the parties how can it he said that the schedule rate Is always maintained the rate rest on the whim of the carrier And such te not the Intent of the law The action of the defendant Is in dis sonance with the letter and spirit or the interstate commerce act Appeal Elks Lodge
