insurance is taken after the original deposit notes are filed and that such cash premiums shall bear the same proportion to the deposit note taken at the same time that the orig inal paid in cash shall bear to the amount of deposit notes originally given To this extent it may be that cash premiums can be allowed to be taken by mutual companies but if thi provision in section 1138 means more than this it is repugnant to the body of insurance laws in this state in my judgment In regard to the insurance laws of the state as a whole he says I think it must be apparent thai there is much confusion in our insur ance laws as they now stand and that natural lines of distinction between the different kinds of insurance have not been recognized It there fore appears that general provisions are sought to be made applicable to two kinds of companies when in the na tare of things it is impossible to them Since there is no way by there can be accumulations or in a mutual company it is difficult t see how its accumulations or profits can be invested In view of the apparent of some of the provisions of the insur ance law to the whole system of laws itself it is difficult to determine
