District Attorney Dib Waldrip, County Counsel Geoff Barr and Precinct 2 Commissioner Jay Minikin went to the monthly Garden Ridge city council meeting asking advice about setting rules regarding businesses such as adult bookstores, cabaret or strip bars. A similar meeting will be conducted Monday night before the New Braunfels City Council. Barr said Waldrip gave a 30-minute presentation on the county’s proposed new order regulating the businesses. “There were a lot of people there,” Barr said. The county became embroiled in a federal lawsuit when it closed an adult bookstore and novelty shop alongside southbound Interstate 35 at the York Creek Road exit. The business alleged county rules were designed to prohibit the business instead of regulate it — a violation of First Amendment rights. The federal case will get to court this fall. Barr said Thursday the county’s legal staff was close to completing work on its new draft ordinance, which will be referred to commissioners for action by late September or early October. Garden Ridge passed its own SOB ordinance in 2000, after Mayor Jay F. Feibel-man became concerned one of the businesses could locate on Farm-to-Market Road 2722. With the city’s regulations, Feibelman said, he doesn’t expect to see one of the businesses coming to Garden Ridge. But he’d like to make sure one doesn’t come to Bracken, either. Bracken, which is not incorporated, would fall under the county’s order. “We adamantly support the county. We don’t want them here,” Feibelman said. “We know they deteriorate property values. They increase the crime rate and the drug problem. It’s bad for the children. There’s nothing redeeming about a porno place." By Ron Maloney Staff Writer Comal County Judge Danny Scheel presented his proposed budget for 2004 to commissioners Thursday. If approved as submitted, the new budget would not raise the county’s tax rate — and would put about $150,000 back in the county’s reserves. “I encourage you to go through it,” Scheel told com-missioners. “If you have changes, you have the opportunity to amend it Aug. 28.1 can tell you that, as in past years, I will not vote on this budget. I present it to you the way I want it, and I’m happy with it.” The budget allows a 4 percent raise for elected officials and a 2 percent raise for employees with a 2 percent merit increase possible at mid-year. Precinct 4 Commissioner Jan Kennady said she would not accept the raise while in office. At a glance Comal Count/# proposed 2004 budget would not Increase the current tax rate of 33.37 cents per $100 of assessed value. “I campaigned saying I would not take an increase, and I will honor that,” Kennady said. “Incidentally, my commissioners’ pay is a lot more than I made as the mayor of New Braunfels.” New Braunfels elected officials are paid a small stipend for attending council meetings, but no other salary. The budget also creates a new road crew, two additional clerks in the county clerk’s office and a second County Court-at-law. County Human Resources Director Bob Grazioli said county employees made it easier to make ends meet by keeping health insurance claims down and limiting this year’s insurance increase to IO percent.
