sentence FROM STAFF REPORTS A 45yearold San Antonio man received a 180day sentence in the county jail after pleading guilty to a twoyearold charge of driving while intoxicated Stephen G Mcelroy pleaded guilty to a Class A misdemeanor charge of driving while intoxicat ed after a Comal County jury deadlocked in his trial on a felony DWT charge Mcelroy was arrested in Comal County on Jan 30 1998 He was charged with a thirddegree felony DWI charge because he had three or more previous DWI offenses He was released on a bond A Comal County grand jury indicted Mcelroy in August 1999 Mcelroys trial began Monday morning with the prosecution presenting evidence Monday afternoon The jury began deliberations Tuesday evening Jim Noble Comal County assis tant district attorney said the jury deliberated three and a half hours then sent out notes indicating they were deadlocked On Wednesday morning Comal County prosecutors and Mcelroys defense attorney David Warts reached a plea agreement and Mcelroy pleaded guilty to the less er charge He was sentenced to 180 days in jail 18 months probation and fined He also will have to serve 24 hours of community ser vice and attend alcoholdependen cy counseling State district judge Jack Robison presided over the trial If convicted of the thirddegree felony charge Mcelroy could have faced up to 10 years in prison and a fine up to Horticulture committee offers landscape design course Seguin seniors strike up the band SPECIAL TO THE HERALDZETTUNG SEGUIN The Seguin Activity Center welcomes the merger of die Seguin Community Band Seguins only community band into the operations of the Seguin Activity Center The new name is a combina tion of two organizations and the band will continue as the Seguin Activity Centers Community Band The band will conduct regular rehearsals at the Activity Center and the functions will be scheduled through the Activity Center The band meets for either a practice or a concert on the first and third Thursdays of each month The 25member allvolun teer band will average about 20 to 25 performances a year This years officers are Sherry Dawson vice president and instrument librarian Neighbors
