in the future If future spot checks find similar discrepancies processors could face civil penalties and fines Perry said Texas surveyed the 15 schools and four supermarkets in April and early May as part of a 20state study requested by the Federal Trade Commission and the Department of Agriculture Nationally more than 40 percent of the groups of packages inspected contained less than claimed on their labels according to the federal report Texas record on milk was worse There was nearly a 60 percent failure rate on school cafeteria inspections and 50 percent in supermarkets The state also found some failures in testing juice but it was not close to the level in milk containers Perry said While the states sample was tiny Perry said he believes it is accurate citing the similar findings nationwide Perry said Texas recently has adopted national measurement standards and part of the reason for the discrepancy could be stricter testing methods Susan Ruland of the Milk Industry Foundation in Washington whose members package about 85 percent the nations milk said the industry is working with federal and state officials on an education program extended to visiting booths with
