property tax relief on Itheir land according to Lynn jRodgers chief appraiser of the jjComal Appraisal District They may apply for a special lower appraisal of their land based on what the land I will produce rather than what it would sell for in the open he said The Texas Constitution provides for two typesof special Rodgers said Article 8 Sec 1dl addresses what is often known as openspace land appraisal Article 8 Sec 1d addresses agricultural use or aguse appraisal Land owners must file for special appraisal at the appraisal district office by April 30 Those who must file this year include owners of land under 1d appraisal and land owners whose property did not previously receive 1dl appraisal The appraisal district must accept latefiled 1dl appraisal applications until the day before the appraisal review board approves the 1997 appraisal records but late applications will draw a penalty The requirements for applying and qualifying both the land and the owner are different for the two types of Rodgers said Most property owners apply for 1 d1 appraisal To qualify the owner must use the land for agriculture growing timber or as an ecological laboratory This form of appraisal does not restrict ownership to individuals and does not require agriculture to be the owners primary business This special appraisal requires that the lands use in a qualifying agricultural or timber purpose meets the degree of intensity generally accepted in the area And the owners must show that they devoted the lands use principally to a qualifying use for at least five of the preceding seven the Emergency Food Assistance Program Income guidelines must be met by all applicants The Office of Management and Budget has determined the income criteria Applicants of younger than 60 years must be at 130 percent of the poverty level Applicants 60 years of age or older must be at or below 185 percent of the poverty level published by the Office of Management and Budget Applicants who have been certified for assistance such as Aid for Dependent Children Supplemental Security Income or noninstitutional Medicaid benefits may also be eligible Proof of residency income and personal who has the 1d appraisal if sells the land or changes its use The rollback extends back for the three tax years before the year in which the change or sale occurs Under 1dl an owner triggers a rollback by changing the lands use to a nonagricultural use The roll back taxes are based on the five tax years preceding the year of the change The rollback tax is the difference between taxes paid under productivity appraisal and the taxes that would have been paid if the land had been put on the tax roll at market Rodgers said The law also requires that the rollback tax include interest charges Land owners must apply for productivity appraisal with each appraisal district in which they have land Failure to do so could result in land owners paying taxes on the lands full market value
