ELIZONDO Jr. Associated Press Writer AUSTIN — About 1.5 million Fox television viewers could miss a little thing called the Super Bowl as the network and Time Warner Inc. play a big game of chicken. The companies are busy pointing fingers at each other and warning football fans and cable viewers in Austin; Tampa, Fla.; Kansas City, Mo.; Milwaukee; and Detroit to dig out their "rabbit-ear” antennae. Time Warner owns cable systems in those cities. Fox, in full-page newspaper ads run Monday and Tuesday, says Time Warner is forcing it to turn off local stations in those markets on Jan. I because the cable operator won’t renegotiate contracts for access to the local stations. Time Warner says Fox is threatening to cut off the signals because Time Warner isn’t carrying the network’s all-news station in New York. I it will only be because Fox forced us to do it,” said Michael Luftman, a spokesman for Time Warner. While the companies are blaming each other, some football fans are blaming them both. "I’ll be hacked,” said Todd Baker, a 21-year-old University of Texas student. "I’ll be hacked at both of them. It looks bad. Especially because it’s two big companies. There has to be a way to work it out.” Cable subscribers could still reach the local stations at home by satellite or antennae. "Time Warner Cable’s contract to carry the Fox network ends on Dec. 31, 1996,” Fox’s ad in Austin says. "Fox asked Time Warner Cable to negotiate a new agreement. Time Warner’s response has been to file a lawsuit.... We at Fox are very hopeful that a new agreement can be reached ... so that programs ... will be available.” Jim Platt, a spokesman for Fox parent company News Corp., said the ads are meant to get viewers involved. "It’s to let the viewers know what’s happening,” Platt said. "Maybe the viewers will have more luck getting Time Warner’s attention.” Luftman says Time Warner filed a lawsuit in Florida to force Fox to abide by two contracts between Time Warner and Fox. He said the contracts run through 1999 and don’t need to be renegotiated. One of the contract says Time Warner will have access rights to network-owned stations at least through 1999. Time Warner says that contract applies to the five local stations in question because Fox recently purchased them from New World Communication Group. But Platt said Fox should be compensated for access to the stations. He said the Fox network is a valuable asset and Time Warner should pay something for it. He said Fox isn’t necessarily looking for channel space for its news station or for cash payments, but wants to negotiate a fair deal. Luftman said Time Warner compensates cable networks for their signals, but doesn’t pay for local stations seen for free by non-cable subscribers.
