New Braunfels Herald Zeitung (Newspaper) - August 19, 1987, New Braunfels, Texas Commerce & Industry Texas Business Today Temporary workers — possible liabilities? By MARY SCOTT NABERS Com missioner L>ear Commissioner N abets:    I recently hired someone to do a tem porary job for me He knew it would only take a lew days and yet when the work was finished he filed a claim for unemployment benefits Now TKC says they are going to pay the gu> I thought an employer didn t have to worry about this if someone w as lust temporary or part-time DC Marble Falls Dear DC.: You cannot imagine how many times a week someone in my off ice answers this very question Sometimes I feel like dropping leaflets all over the state to get the word out There is NO DIS [TNC TION under the law of unemploy ment compensation between tem porary. permanent, probationary, part-time or full time employees. Any unemployed individual can file a claim for benefits Whether a elal mant is paid depends upon the reason he was separated from tins last work ll the work ends, as in your situation, then he is laid off for lack of work and will most likely receive benefits Your business will have immediate financial liability on the claim only ii the individual worked for you long enough to have w ages from your company in his base period Which firings us to our next question Dear Ms. Nabers: Please explain what the “base period" is F D. Marta. Texas Dear F D.: The base period is a year s worth of wages The Commis sion looks at these wages to deter mine a claimant's monetary qualification for benefits as well as t h e a c taal be n e f i t a rn o u nt Kmployers who paid the w ages earn ed during the base period are poten bally liable on an unemployment claim It is not possible to know for sure what the base period on any in dividual will be until that person tiles a claim You can. however make a reasonable calculation by first assuming a claim date Then Disregard the quarter in which tin' claim is tiled Disregard the quarter im mediately preceding the claim quarter Look at the four quarters preceding those This is the base periodWAL-MART Prices good through August 29!
