With a few exceptions this is a workable ordinance. It’s a move in the right direction. “I voted against the first draft at the committee meeting because it was something I could not support. Nobody has as much at stake to lose at this than I do. I have put everything I have into my business. “A very serious thing almost oc-cured when a small group of people made a decision about other people’s business of which they knew or had nothing to do with. This is an extremely complex issue. “I have a problem with the 2,000-foot spacing of off-premise signs. That comes close to an effective ban on billboards. It puts a vast majority of my signs into non-conforming standards. If I’m not able to move my signs around so that I am able to profit from my investment that is a slow cancer that will put me out of business. There is a supply and demand here our we wouldn’t be in business. “If they truly want to make the spacing of off-premise signs realistic they need to look at the fact that 2,000 feet is four times the distance prescribed by current state law (State Department of Highways and Public Transportation Spacing Regulations For Off-Premise Signs, article ’1.451, para. B. i “There are many things to take into consideration when considering spacing such as buildings, cross streets and curves. “They also need to look at the stipulation that would not allow a non-conforming off-premise sign to In* repaired, if damaged, if repairs exceed 50 percent of replacement cost. Insurance companies do not reimburse loss unless it exceeds 70 to 80 percent of cost. Page 14A Draft text of proposed sign ordinance An ordinance amending Chapter 18A, code of ordinances, City of New Braunfels, Texas, regulating the size, height and location of both on-premise and off-premise signs within the City of New Braunfels, Texas, and its extraterritorial jurisdiction; otherwise regulatting signage; repealing all ordinance or parts of ordinances in conflict herewith; providing a savings clause; providing in conflict herewith; providing a saving clause; providing a penalty for violation and establishing an effective date. Be it ordained by the city council of New Braunfels, Texas: I That Chapter 18A, Signs and Billboards, Sections 18A-1 through 18A-14 of the code of ordinances is hereby amended by adding the following provisions to be known as Chapter 18A, Signs and Billboards, which shall read as follows: SECTION 18A-1. DEFINITIONS. A. Sign. Any device or surface on which letters, illustrations, designs, figures or symbols are painted, printed, stamped, raised, projected or in any manner outlined or attached, and used for advertising or identifying purposes. B. Off-Premise sign. Any outdoor advertising device directing attention to any business, product, service or activity not offered, sold, or conducted on the same premises where such advertising is located. C. On-Premise Sign. Any outdoor advertising device pertaining to an activity, product, or business conducted or sold at the location on which the sign is located I) Traffic Sign. A sign that gives direction to either pedestrian or vehicular tr affic. E. Portable sign. A transportable sign of durable construction on wheels, skids, legs, or framing, including trailers and search lights used for advertising or promotional purposes, which is not designed or intended to Ix* permanently affixed to a building, other structure. or the ground, but which is capable of being so anchored. SECTION 18A-2. JURISDICTION. These regulations shall be in full force and effect with in the corporate limits of the City of New Braunfels. Texas, and within its extraterritorial jurisdiction as authorized by the State of Texas. SECTION 18A-3. OFF-PREMISE SIGNS. The following regulations shall apply to off-premise signs only. A. Preexisting off-premise signs. The lawful use of any off-premise sign existing at the time of the enactment of this ordinance max be continued although such does not conform with the provisions of the ordinance However, the right of nonconforming uses to continue shall be subject to the following specific regulations: 1. A nonconforming off-premise sign may be maintained by the owner, but shall bot be added to, enlarged, or modified in any manner. 2. A nonconforming off-premise sign which is damaged or partially destroyed by fire, flood, wind, explosion, earthquake or other calamity or act of God, shall not be again restored or used as an off-premise sign if the expense of such restoration exceeds 50 percent of the replacement cost of the off-premise sign at the time such damage occurred. B. Size requirements. 1. Sign structure shall have a maximum of 2 sign faces. 2. The size of any single sign face shall not exceed 672 square feet along the interstate highway, and shall not exceed 800 square feet along any other street or roadway. 3. The maximum height of a sign shall be 4212 feet from the road grade to the top of the sign along the interstate highway, and a maximum height of 30 feet from the road grade to the top of the sign along any other street 4. The bottom edge of the sign must be at least 14 feet above the ground C. location of off-premise signs. No off-premise sign shall be located within 2,000 feet on the same side of a street or roadway from another off-premise sign. The distance shall be measured in linear feet at the center line of the street or roadway. Signs must be located on private property and may not encroach on any public right-of way. easement, or within a IO foot radius from all electric power poles, lines and crossbars. I). Traffic safety. No sign shall be permitted which would interfere with pedestrian or vehicular traffic safety in the opinion of the planning director of the City of New Braunfels. E. Permits. 1. It shall be unlawful to erect, construct, install or place any off-premise sign without having obtained a permit from the building department of the City of New Braunfels. Such sign permit shall be issued in accordance with the procedures for building permits as established by the City of New Braunfels. 2. A permit shall be required for the changing ot the advertising copy or message of the painted off-preuuse sign or for electrical, repainting or deaning maintenance of an off-premise sign. 3. The planning director is authorized to issue stop orders for any sign which is being constructed in violation of this chapter or any other ordinance of the City of New Braunfels SECTION 18A-4. ON PREMISE SIGNS. The following regulations shall apply to to onpremise signs only. A Pre-existing on-premise signs. The lawful use of any 011-premise sign existing at the time of the enactment may be continued although such does not conform with the provisions of the Ordinance. However, the right of non-conforming uses to continue shall be subject to the following specific regulations: I. A nonconforming on-premise sign may be maintained by the owner, but shall not be added to, enlarged, or modified in any manner. 3. A nonconforming on-premise sign which is damaged or partially destroyed by fire, flood, wind, explosion, earthquake or other calamity or act of God, shall not be again restored or used as an on-primise sign if the cost of the restoration exceeds 50 percent of the replacement cost of the on-premise sign at the time such damage occurred. B. Maximum number of freestanding signs. THere shall be a maximum of one freestanding sign per street frontage for any business location. C. Size requirements. 1. Sign structure shall have a maximum of two faces and the size of any single face sign shall not exceed 300 square feet. 2. The maximum height of a freestanding sign shall be 424 feet from the road grade to the top of the sign along the interstate highway, and a maximum height of 30 feet from the road grade to the top of the sign along any other street. I). Traffic signs. Traffic signs shall not be limited in quanity. They may have no more than two sides and each shall not exceed four square feet. Traffic signs shall not exceed the height of four feet above the ground level. E. Roof signs. Roof signs shall not extend above the highest point of the visible roof line. F. Traffic safety. No freestanding, onpremise sign shall be permitted which would interfere with pedestrian or vehicular traffic safety in the opinion of the planning director of the City of New Braunfels. G. Permits. I It shall be unlawful to erect, construct, install or place ain freestanding on-premise sign without hawing obtained a permit from the building department of the City of New Braunfels. Such Mgn permit shall be issued in accordance with the procedures for building permits as established by the City of New Braunfels. 2. A permit shall not be required for tlx* changing of the advertising copy or message of the painted sign or for electrical, repainting or deaning maintenance of an on-premise sign. 3. The planning director is authorized to issue stop orders for any freestanding sign which is being constructed in violation of this chapter or any other ordinance of the City of New Braunfels. SECTION 18A-5. PORTABLE SIGNS. A. It shall be unlawful for any person, firm, or corporation to display, erect, construct, or locate within the City of New Bruanfels and its extraterritorial jurisdiction, any portable sign, or cause the same to be done. B. All portable signs existing on the effective date of this Ordinance and conforming to previous ordinance, shall be awarded legal nonconforming status if registered with the office of the director of planning within 60 days after the effective date of this ordinance. At the time of registration, and annually thereafter for the duration of the period of display, the owner of a portable sign shall pay an annual registration fee of $10. The first year of registration shall be considered to begin on the date of initial registration and end on Dec. 31, 1987. Thereafter, annual registration periods shall correspond to the calendar year, Jan. I through Dec. 31, of each year. The registration fee for the initial registration year shall be $10 and for each calendar year thereafter shall be the sum of SIO. All registration fees for subsequent registration years must be paid no later than Jan. 31 of the registration year. Failure to register an existing portable sign, or failure to pay the annual registration fee within the prescribed time period, shall be considered a violation, and such portable sign shall be removed at the owner’s expense. Removal of any portable sign from the location identified at the time of registration shall result in a termination of nonconforming rights. A portable sign may not be replaced by another portable sign. Permits for portable signs shall not be transferable from one owner to another owner. SECTION 18A-6. VARIANCE. A. A relaxation of the terms of this chapter may be permitted where such variance will not be contrary to the public interest and where, because of conditions peculiar to the property, result in unnecessary and undue hardship. B Any variance obtained under this section shall be granted by the zoning board of adjustment of the City of New Braunfels in accordance with its lilies of operation and procedure. SECTION 18A-7. VIOLATIONS AND PENALTIES. Any person, firm or corporation or agent who shall violate a provision of this ordinance or fail to comply therew ith shall be deemed guilty of a iiusdeineanor.
