tomorrow a new era begins Tuesday is an offyear election day on which the voters will try for size the Voting Rights Act of 1965 for the qualification of a citizen to vote will be in effect for the first lime Tuesday in a scattering of elections Congress has ruled by law that a citizen must be counted as qualified to vote even though the citizen can neither read nor write nor possess any know ledge on any subject The voting rights bill was enacted in angry protest against condi tions in some southern commu nities where Negroes were excluded from the polls To effect this protest and correction Congress stomped shortcut through the Constitu tion That document seems to many persons to insist that the states and not the federal government determine the qua lifications of voters in all elections state and local The 1965 act forbids election officials to require as prerequisite for voting or registration that a citizen theAbility to read wrote understand or interpret any matter Demonstrate any education onal achievement or his know ledge of any particular subject good moral charac ter qualification by the voucher of a registered voter or members of any other class These standards apply at the discretion of the attorney general to any state or county where discrimination against Negro citizens by means of such tests is proved to the satisfaction of the attorney general President Johnson pro claimed special war against literacy tests in southern states in which the number of registered voters was unrepre sentative of the total potential vote The lawis applied wherever there was a literacy test and fewer than 50 per cent of the potential voters in the state were registered and voted V i Southerners were shocked and enraged when it was shown that LBJs Texas would be exempt fromthe 1985 act Sen Harry F Byrd DVa sharply analyzed the bill as it applied to Virginia and did not apply to Texas Byrd said Attorney General Nicholas Katzenbach had not shown that Virginia election laws discriminated against Negroes He Kalzenbach gdmits Byrd continued that this bill which he has drafted for the administration is fixed so that it can incriminate Virginia and so that he can exempt Texas from its application He says Virginia is caught in his numbers game because 41 pet cent not 50 per cent of its voting age people voted in the 19fi4 presidential election But numbers racket When asked why Texas was outhe said Texas is out for the reason that it does not have a literacy lest Byrd said Katzenbach was misleading the people into believing that Virginia had a literacy test Of course Byrd and Virginia lost this argument The law requires that in Virginia and five other southern slates absolute ignorance of absolutely everything qualifies a citizen to vote in all elections including party primaries Thus substandard ignorant citizens would qualify to vole in elections for political office and equally to vote In state and local elections with respect to
