By the K I N G, A PROCLA M A T; I ON, appointing the Diftribution of Prizes �taken; and the Bounty for Taking or Defraying Ships of War or Privateers of the Enemy, from the time of His Majefjs Declaration of War again]} Spain. -.. HEaEAS by an Aft of Parliament made in the laft Seffions of Parliament, intituled, An Aft for the Encouragement of Seamen, and the-more fpeedy and effectual manning His Majefb/s Navy j it is, amongft other Things, enacted, That the Flag Officers, Commanders, and other Officers, Seamen, Marines, and Soldiers, on board every Ship and VefTdi- of War in Our Pay, mail have the fole Jn-tereft and Property of and in all and every Ship, Veflel, Goods .and Meichandizes, which they fhall take from and after the Second Day of January, in the Year of Our Lord One Thoufand Seven Hundred and Sixty Two, during the Continuance of this War againft Spain, (being firft" adjudged lawful Prize in "any of Our Courts of Admiralty in Great Britain, or in Our Plantations in America, or elfewhe're) to be divided in fuch Proportions, and after fuch Mari-ner, as We, Our Heirs and Succeflbrs, fhalf think, fit to order and direct by Proclamation or Procla'-' mations, to be ifTued for ~ thofe-Purpofe's".' 'Arid whereas by the faid Aft, the Prgvifioris and' Regulations eftablifhed by an Act p'affed in the Twenty" Ninth Year of the Reign of Our late Royal Grandfather, for better carrying orr the faluta'ry Pu'rpbfes intended in theProfecurion of the War againft France," as explained-and amended' by/another Adlp'a'ffed'in-the. Thirty Second Year of the Reign of" Our late Royal Grandfather, refpecting the granting" Com-" millions .or Letters of Marque, the Perfons.'acting, and Captures made under the Authority ' thereof, and alfo all other Claufes^and Provifos, contained in the faid Acts, are extended to the Granting of Com-niiffions or Letters of Marque, and all ether Matters and Things whatfover in re'fpect of the fame, during the Continuance of the pre/ent War with Spain, as fnJJy, amply, and effectually, as if the faid Regulations and Provifions had heen particularly repeated and re-ena&ed in the faid Act of the'laft Seffior* of Parliament; And whereas by the faid Act, the Regulations refpecting Prize or Bounty' Monies contained in an Act paifed in the Thirty Third Year of the Reign of Our-late Royal Grandfather, are alfo enacted to be in Force with regard to any Prizes to be made during tire Continuance of the faid War with Spain : And whereas it is enacted, by Virtue of the Provifions herein before recited or referred to, That there fhall be paid by theTrea-farer of Our Navy, upon Bills to be made forth by the Commiffioners' of the Navy, to be paid according to theCourfe thereof, without Fee or Reward, onto the Officers, Seamen,"Marines, Soldiers, or. others, that have been actually/on board any of our Ship or Ships of War, orPrivateer or Privateers, in any Action where any Ship or' Ships of War, or Privateers, /hall have  been taken from the Enemy, funk, burnt, or otherwise deftroyed, fince Our Declaration;of War againft;Spaih,^dated the faid Second Day of "January, 'One ^p^Gnd Seye.n Hundred and Sixty Two/ Five Pounds Jfp'f ^every Man which was living oh board Jany Ship"or; S^hips fo taken,.'funk, burnt, or otherwife deftroyed, at the Beginning of the Engagement between them ; [ Price Three Pence. } the Numbers of fuch Men ,to be proved by die Oaths of Three or; more of the Ghief Officers, or Men, which were belonging to the faid Ship or Ships of War, or Privateers of the Enemy, or belonging to any of them,, at the Time-of her being taken as Prize, funk, burnt, or otherwife deftroyed, before the Mayor, or other Chief Magiftrate of the Port* within any of Our Dominions, whereunto any Prize* or Officers, or Men, of .inch- Ships- as were funk; burnt, or otherwife deftroyed, fhall-j be brought, of" before the Britifh. Conful, Or Vice-Conful, refiding at any Neutral Port to which, fuch Prize, or Officers; or Men, lhall be brought; which" Oaths -the faid Mayor, or other Chief, Magiflrate of^any fu'cfrPorty or Conful, or Vice ConGil, .are thereby fefpectiVely impowered and jequired, to-adminifter ;'and'fhalf forthwith grant a Certificate.thereof, without Fee or Reward, directed to the CommiffioneK of the Navy'; upon producing; which Certificate :to the Conrmifr; fioners of Our Navy* together with an authentic^; Copy of the Condemnation of fuch-Ship fo taken � or if fuch Ship be funk, burnt, or otherwife de-^ ftroyed, on producing..only a-Certificate from the' Mayor, or other Chief Magistrate, or Conful, of Vice Con(ul, as. aforefaid, the faid Commiffioners' of Our Navy, or fuch Perfon or Perfons as they' fhall appoint for that Purpofe, fhall,: according id the Courfe, of the Navy, within Fifteen 'Days/ makel out Bills for the Amount of fuch Bounty; dire&ed to the.Treasurer of the Navy,, payable to, -and to be' divided.amongft the Officers, Seamen-,' Marines and' Soldiers, on board Our Ships of War, in Manner;' Form, and Proportion/as- by Our Proclamation to* b'ejfl'ue'd for .that Pttrpofe:.fhall be directed- and ap-;> ^pointed -r and amongft: the ^Owners, Officers* and . Seamen, of any private VeiTel or Ship of .War, fuch Manner and Proportion, as, by any- Agreement in Writing, they fhall have entered into for that Purpofe, mall be directed : Bat it is neverthelefs provided.by the faid Act, That in all Cafes where' iuch. Oath and Ceruficate cannot be admmifterai and granted at the firft. Port whereunto any Prize, or.Officers, or Men^of fuch Ships-as fhall be taken* funk, burnt, or otherwife deftroyed, fhall be brought* fuch Oath or Oaths relating :6 any Prize or Prizes ' that fhall betaken,.or to any Ships of Our Enemies that fhall be :funk, burnt, or otherwife deftroyed* as aforefaid, fhall and may be adminiftered aiid taken by and before the Mayor, or other Chief Magiftrate of any Port within any of Our Domi-� nions, or by or before the Britifh Conful, or Vice Conful, refiding; at any Neutral Port whereunto any. Prize* or. Prizes, or Officers, or Men* of any Ships belonging to Our Enemies, as fhall be taken, funk* burnt or otherwife deftroyed, fhall at: any Time afterwards be brought, (Proof being firft made, by Affidavit before, fuch Perfon or Perfons, of the Inability of making: fucbr Oath or-Oaths, and obtain* ing.fuch Certificate at the faid firft Port) and the Mayor, or other Chief Magiftrate, Conful, or Vice" Conful, fhall thereupon grant iuch Certificate and Certificates as ;are therein before directed 3 whiclf. Ceruficate and Certificates fhall be good and effectual, to all Jntents and Purpofes, as if the famtf were granted by the Mayor, or other Chief Magr-" ftrate, Conful,,or Vice Confcl, of the Port to which* fuch Prize or Prizes,.
