Watch Company Broke Its Contract with the Iwo Ohio Watchmakers Hired to Come Here by Superintendent Moreland and That One of the Defenses of the Company was Absurd Judge Bsasley this morning filed a long opinion in the City District Court in tlie case of Q Paine and Charles aE Stanley watchmakers of Canton Ohio who the Trenton Watch Company for each for breach of contract He orders judgment for each plaintiff for The case has become well known And is the employers and employ PS W A Sanford the plaintiffs and George M Robeson Bensley regrets in his opinion the case wni not tried before a jury In a review of tbe testimony the Judge gives copies of the tetters which be- tween tba partners and which form the con- tract the induced to Trenton for the purpose of positions here by Mr Moreland superintendent of the defendant company The contract between tbe parties virtually this On the part of tho company we at a sum per 100 and there will be plenty of work for you On part of the plaintiff the contract was we accept your terms and we will work for you at this price the work to 1 It originally the intention o the Superintendent to have the plaintiffs a the July wrote plaintiffs that they need not come until th first of August The works did not start that and tho were tild by Mi Lawrence Farrell thac he would be responsi ble for their board Mr afterward reconsidered bis offer be learned tba the works were not to run for some time Mr Paine work at factory nnd to work at the work on October 2 The contract is indefinite time being fired for its termination Tn concluding the the Judge says In the before the court it will bo seen tbat the plaintiffs when they came to Tren ton and offered themselves ready find willing to their part were by the ile company to in Trenton unti the works opened If tho works had on August 1st and tbe plaintiffs had into the employ of the company it cannot b doubted but that they could have been for a1 good cause discharged by tba tendent at any time or if the ploy of tbe company J tbe works had shut down for reason they certainly could recover for their wages for tbe time the works shui But here find the acting the stating pany has broken its contract with he Tne plaintiffs therefore entitled able to determine what should be measure of in a case of this kind was no proof offered in the to expenses tbe plaintiffs had been put to in coming from Canton nor was there any testimony to show what expense had been pnt to while out of work in Trenton That the plaintiffs are entitled to some for of this contract my mind clear The will be tbe expense of coming I to Trenton nnd going back to their home the money expended for board while in Trenten and finally damages for loss of time while ill and reasonable damages for timo lost in seeking other employment first of the opinion that t measure of damages in this case would ba the amount of wages that the plaintiffs would have made bail they fiom August 1 to October 2 which was the date of tbe factory Bit he Contract is so indefinite that I hesitate to lay this principle wf law If the time of the ment had been fixed 1 would bave bad no difficulty in this case but it is left indefinite by both parties how Wng the hiring to Dili Not of CITY For Salo continue Tho plaintiffs were to btart work August nothing Js said in flig how long this work was to continue lam sorry that a jury was not called in this case that they might fix the measure of damage but talcing the whole case into consideration I am satisfied tbat the better in cases of this kind be to hold that are entitled damages as will naturally result from tbe breaking of the C5ntritfct upon I estimate this damages nt in each case I might add that one of the defenses set tip by N 5 and former prices 10 to
