s o c i a t e Justice Benjamin N Cardozo of the United States supreme court died at P M today at the home of Justice Irving Lehman of the New York court of appeals At his bedside were bers of the household and his secretary Joseph Paugh who announced the death Cardozo had been ill with heart trouble since last winter In the last few weeks he had spent much time in an oxygen tent Justice Cardozo was 68 last May 24 He had long been a friend of President Roosevelt and only today the president and Mrs Roosevelt sent flowers to him He came to Justice Lehman's home from Washington in June to spend the summer after being forced by his illness to miss all the spring sessions of the court His death ended more than a week's fight to overcome a relapse from the old heart ailment The first news of the relapse came on July 2 when physicians reported he has not been doing so well For the last three days the condition had changed but it seemed he was ing ground by inches Then early today his secretary announced that Cardozo had passed a poor night but otherwise his condition is un- li A staunch supporter of the New Deal philosophy he was ed to the high tribunal by dent Hoover He voted 22 times to support New Deal sponsored laws In only five cases did he turn against en- and in those instances the court's decisions were un- animous Cardozo shunned legal contending that the law does not stand upon punctilios A Gentle Scholar The frail soft-spoken scholar was appointed to the court on ruary 15 1932 to succeed the late Oliver Wendell Holmes another famous liberal He came to the supreme court bench from the chief of the New York state court of appeals He was the second member o the Jewish sit on the tribunal The first was Justice Louis D Brandels appoint ed in 1916 by President Wilson written opinions wen noted for their crystalline clarity and beauty of expression He wa generally as the literary of the tribunal A bachelor he had tew socia contacts While in
