has been reported by the majority of this committee fail to pass by a sub- unanimous vote it will be said that for years Gen Porter has been trying to gel action upon this case and never until this particular period and under the present peculiar circumstances has he been able to get it and now he gets a biil passed out favorable recommendation of the dent by a simple majority of Congress and in violation of n well-established ciple of government that sentences of courts-martial should not be annulled by Congress It is said that Porter does not want a second trial and as suggested by a member of Congress to-day if a second trial conld be legally given it might result in Porter's being shot said this member even if a second martial should be allowed Porter could snap his fingers at its orders for in point of fact it would have no authority over or power to compel Porter to stand He is out- side of the jurisdiction of any military unal and would not subject himSelf to another as
