Proposes To lize Salary By Special Legislate Act county judge who we to be elected during the next ensuing year and that no change in salaries shall be made ing the term of office of such officer or county judge The arrangement increasing the salary from a year to which was entered into by Judge er and the board was made in the fall of 1901 when in should have been made in order to comply with the law in the fall of 1900 so as to affect the salary of the county judge to be elected during the following year It has been claimed all along by Judge Becker that he made an applies The light is beginning to break on Judge J M Becker of the Green county probate court He sees breakers ahead that threaten his appeal to the circuit court from the action of the county board in disallowing fees he charged up against the county and be has found it advisable to back down the matter of dropping his appeal now being iously considered He has come to that in respect to salary at least he is at the mercy of the county board and the people of the county who pay it A proposal for the withdrawal of his appeal was made at a star chamber session called by Judge Becker at 4 o'clock Friday afternoon Judge Becker giving it out that he had a little business s proposition to submit Those who attended this session were Chairman W F of the county board M C Settings Andrew Lewis comprising the co nty committee which is authorized to settle with outgoing officers District ney Wm H McGrath representing the county's legal Judge erand A S Douglas adviser The business proposition seemed to be decidedly in the interest of the judge instead of being in the in- terest of the county that was supposed to be represented Judge Becker had prepared an elabor- ate On his part he agreed to drop his appeal and f to fees such as he has been charging against the county if the tives of the county would sign the agreement which would bind the board to support him in his efforts to get a through the legislature izing the salary arrangement made the county board in 1901 by which his salary was raised to He did not ask that the representatives of the county commit themselves to this amount for his salary but he wanted them to agree to a that would the county board to fix his salary at not less than for the 1904 which was before his second re- election for a raise in salary for the county judge who might adopted by the board in 1901 Judge Becker ing to have it appear that the under- standing was that when the board fixed his salary in lieu of all fees and clerk hire it only to have it cover fees chargeable against the county But the representatives of Othe county balked District Attorney McGrath took a position against the agreement and none of the others present would have anything to do with tion Attorney Douglas it is said was only half-hearted in urging the agreement District Attorney McGrath agreed to consent to a withdrawal of the appeal The session lasted two hours Back of this maneuvering is the de- fense that hag been planned by District Attorney McGrath for the county in case the appeal is pressed It is understood that the district at- torney advised Judge Becker that ho intends to put in a counter claim for a considerable sum of money growing out of the increased salary the judge has been receiving for five years The county's right to do this was denied and by agreement Burr W Jones of son was consulted and his opinion ported the line of defense proposed by the district attorney An extension of time for filing the county's answer was next agreed upon It is the contention of the district attorney that the arrangement between the county board and Judge Becker made and entered into in the fall of 1901 whereby the county judge agreed to accept a year in full for salary clerk hire and all fees and charges for services rendered as county judge is without force and effect and concludes that he is entitled to only per annum the regular salary previously fixed for county judge It seems that the statute provides that the board may fix the of county officers including fixed the salary of the county judge for the ensuing term beginning January 1906 This claim the district attorney finds is entirely untenable since the county board took no action whatever as to salary of the county judge for the term beginning January 1906 but ly the appropriation for sufficient to make it an easy matter for anyone to miss the train The change was announced in one of the newspapers of the city and The Times is advised that the local office intended and did hold up the announcement as far as is concerned How did it happen that you did not The Times the notice of a change in Agent Zimmerman was asked this morning the do I care whether The Times got it or replied the com- agent It was suggested that possibly the company might be interested in giving the announcement of the change as much publicity as the limited time mitted but the agent was in no mood to agree with the suggestion or possibly it did not coincide with his idea of practical railroading Mr Zimmerman has been agent several weeks and is f doubtless what irritated because of the complaint for better service consulting the local railroad office i will have to expect to take the con sequences but it can stand it as Ion as the movement is not entirely with out result it means quite a little sum to th county If recovery was made by the count the judge would then have a right t claim the additional fees he claims in taking his appeal Under the law it is provided that if any public official draws money to which he is not entitled any person can bring an action to have such money returned to the public treasury The Times fails to see any reason why the county should expect to get at 2 o'clock Death resulted from pneumonia and general breaking down after a three weeks illness She was born June 13 1843 and came to America in 1868 settling in Ohio and came to Green county the following year She was the wife of Fred Neuenschwander who resides on the Haase place Besides her four children survive her Fred of Davis 111 Will Henry and Rose who are at home The funeral will be in the hospital at the national soldiers home at Minneapolis Four months ago he was stricken with paralysis and since that time he had been confined to the hospital He served in the war and later Perry Madison Mrs Ettie E Crampy and Mrs Minnie M Morin Chicago The family resided here for some years Mr Lawrence being employed as carriage trimmer at the Fitzgibbons plant They moved to Madison ten to Oregon to attend the funeral which was held Sunday The particulars of his death are not known but it is believed that his death was due to jaundice from which he suffered a great deal during the past summer while he was employed by the Carter Hardware company at Freeport While in this firm's employ Mr Faubel was repairing an eave trough when the scaffolding gave away and he was thrown to the ground fracturing a limb and receiving internal injuries which it is thought hastened his death Mr Faubel wus born in Oregon nine years ago and it was there that he was married His wife and two
