IMC HIS SATISFY STATICS WASHINGTON MAY and favorable response to the American mail against England arid France Is confidently expected by the Administration Intimations to day from tho State Department woro that advance discussions between Ambassador and the dp par tin en t had given the Impression England intends to comply with the American demands This was more evident from the fact that the United States did not stipulate exact changes that must be made but instead demanded only the radical change in the policy England knows how ever what terms the United States exacts and as Sir Cecil has ored to head off the note it Is pre he has outlined concessions willing to make As a matter of fact one has said Englands Intentions appear good but her administrative system so faul ty that seizures have continued de pledges to refrain The text of the communication ad dressed to the British and French am to whom It was delivered Wednesday follows Department of State Washington Department of State Washington May 24 16 have the honor to acknowledge receipt of your cys note of April 3 last transmitting a memorandum dated February 15 1916 and communicated in substance to the American ambassador in Lon don on February 28 in which are stated the contentions of the British and French governments In regard to the detain and examine parcel and letter malls en route by son be tween the United Stales and Europe After a of the use ot the mailH for the transmission of par cels ond of the to be plac ed on Inviolable mail the point mem of February 1V close with the following assertions M That from tho standpoint of the right of visitation and eventual ar rest and seizure merchandise shipped in post parcels not and shall not be treated otherwise than mer shipped In any other man ner 2 That the Inviolability of postal correspondence stipulated by the elev The Hague of 1007 does not in any way affect tho right of tho allied governments o visit and If occasion rise arrest mer hidden in tho wrappers cn as to all cargoes on the high seas as asserted in he Joint note under ac knowledgement It is noted with satisfaction that the and French governments do not claim and in the opinion of thin government properly do not claim that their socalled measures are grounds upon to base a right to interfere with all classes of mail matter in transit to or from the central powers On the contrary their content ion appears to be that as genuine is under conventional stipulation able mail matter of other classes is subject to detention and examination While the Government of the Unit ed Stales agrees that genuine corre mail is inviolable it does not admit Hint belligerents may search other private seaborne mails for any other purpose than to discover wheth er they contain articles of enemy own carried on belligerent vessels or articles of contraband transmitted under leased cover as letter mail though they may intercept at sea all mails coming out of and going into ports of tho coasts which arc effectively blockaded The govern ments of the United States Great Britain and France however appear to be in substantial agreement as to principle is the chief cause of dif ference Though giving assurance that they consider genuine correspondence to be inviolable and that they will tnu to their engagements on tin high seas from and ing such the allied governments proceed o deprive nqu tral governments of the benefits ol these assurances by ami con mail from vessels in port In stead of at sea They compel neutral ships cause to enter their own ports or they induce shipping liners through some form of duress to send their mall ships via British ports or they detain all vessels merely calling at British ports thus acquiring by force or means an illegal jurisdiction Acting upon this enforc ed jurisdiction the authorities remove all mail genuine correspondence as OK 1 Cards were received in this yesterday announcing he wedding Ins Thursday of Miss a gentle man of sterling worth who is in way worthy of I lie young lady who has become his bride Mr and Mrs Lloyd will be at home to friends In Canton after June or mail bags That letters contained In the true to their engage ments adn respectful and genuine cor respondence the allied governments will continue for the present to re frain on the high seas from confiscating such correspondence letters or dispatches and will insure their speediest possible as soon as the sincerity of their acter shall have been ascertained In reply the Government of tho United States desires to state that it docs not consider that I ho Postal Un ion Convention of necessarily ap plies to the Interferences by the Brit ish and French governments with the oversea transportation of mails of which the Government of the United States complains Furthermore the allied powers ap pear to have overlooked the admission ot the Government of the United States that post parcels may be treat ed as merchandise subject to the exer cise of belligerent rights as ed by international law But the Gov of the United States docs not admit that such parcels are subject to the exercise of the rights of police supervision visitation and eventual well as post take them lo London where every piece even though of neutral origin and destina tion is opened critically examined to determine the sincerity of their character in accordance with ihe in given that phrase by the British and French cen sors Finally Ihe expurgated remainder is forwarded frequently after able delay to its destination Ships are detained en route to or from I lie United States or to or from other neu tral countries and mails are held and delayed for several days and in some cases for weeks and even months even though not to ports of North Europe via ports This has boon the procedure which has been practiced since he announce ment of February in 11 U To so me extent I he same practice was follow ed before I hat dale calling forth the protest of this government of January 1 Ju I lo that protest Mm mem under acknowledgement no reference and in entirely un responsive The government of tho United Suites must again insist with emphasis that tho and French do not obtain rightful jurisdiction of ships by in ducing them to visit I heir ports for the purpose of their mails or there by obtain belligerent rights as to such ships ban they could exorcise on I ho high seas for opinion of ho Government of the Unit ed States no legal distinction the of mails at sea which is announced as abandoned and their seizure from vessels voluntarily or in voluntarily in port The and French practice amounts lo an unwarranted limitation ol of tho use by neutrals of the worlds highway for the transmission of corre The practice actually fol lowed by the allied powers bo said to justify the conclusion there fore that tho announcement of Febru ary 15 was merely notice that one il legal practice had boon abandoned lo make place for tho development of an other more onerous and vexatious in character Tho present practice is a violation not only of the spirit of the announce ment of February in but of the rule of Hague convention it is based Aside from this it is of the prior practice of nations which Great Britain and her allies have in the past assisted to establish and maintain A Li i M FULTON AT OCLOCK TODAV Tho many of A 13
