Stewart Murder Trial Entering Second Day By DAN RHEA Daily News Saff Writer The murder trial of Bell County magistrate Glenn Dido Stewart goes into its second day in Bell Circuit Court this morning Stewart is charged with the wilful murder of his cousin Col son Stewart of Cincinnati Ohio The first day of Stewart's trial was taken up by the selection of the jury which took over four hours the opening statement and the first five prosecution witnesses The trial continues today with the rest of the case the case for the defense and should go to the jury by this afternoon Special prosecutor Paul of McKee Ky began by reading the Bell County grand jury's in- against Stewart last October 23 to the jury The indictment charged Stewart with shooting and kilting Colson Stewart or wilful murder Then carefully eyeing each juror throughout his presentation outlined the case against Stewart The prosecutor said he would try to prove Colson Stewart was visiting his cousin Glenn Stewart the night of October 8 when Colson Stewart was shot in the jaw with a 357 Magnum revolver He died three hours later in the Pineville Community Hospital continued saying Colson Stewart was not known to possess a gun and that he was unable to drink alcoholic beverages because of stomach ulcers The prosecutor said he would try to show Glenn Stewart got drunk that night and his cousin with malice a- forethought although didn't suggest any motive said after the shooting Stewart called the police and admitted to several policemen that night he did the shooting But said Stewart handed the police a 38 special revolver indicating it was the one used in the shooting The prosecutor then said police shortly afterwards found the actual weapon used a 357 a bed in over Chappaquiddick Still Haunts Sen Kennedy BOSTON UPI The Boston Globe said today Sen Edward M Kennedy escaped serious criminal charges in the death of Mary Jo Kopechne through inept prosecution and preferential treatment by wary officials Miss Kopechne was killed July 18 1969 when a car Kennedy says he was driving went off a bridge on Island Kennedy subsequently was given a two- month suspended sentence and placed on probation for a year on a charge of leaving the scene of an accident In the fourth and final story of a series re-examining the incident the Globe reported in its Thursday Inept prosecution and treatment of dy by law enforcement and judicial officials probing the death of Mary Jo Kopechne apparently saved Sen Kennedy from being charged with serious driving crimes ing manslaughter Routine investigative and judicial procedure was either altered or botched numerous times to Sen Kennedy's benefit during the three official probes of the accident initial police investigation the inquest and the grand jury the Globe said The investigative failings appear to have resulted from an overwhelming deference to Kennedy's power and prestige by apprehensive officials and not from a conspiracy among themselves or with the his opening statement until the conclusion of the case However during opening statement Knuckles objected to the suggestion Colson Stewart did not possess a gun or was unable to drink Special Judge Billy Dickson who is presiding over the case overruled both of Knuckles first objections The first and only sharp exchanges in yesterday's session occurred during the testimony of first witness Daniel Stewart the son of Colson Stewart Daniel Stewart testified his father was 54 years old was from Cincinnati and that he and his father were very close asked Daniel Stewart if he knew of any physical conditions his father had before his death but Daniel Stewart was stopped from answering by an objection from Knuckles Judge Dickson sustained this objection the only one of Knuckles many objections yesterday sustained by the court then asked Daniel Stewart if he ever knew his father to drink alcoholic beverages Daniel Stewart replied his father was unable to drink because of stomach ulcers Knuckles objected to this answer but was overruled In cross-examination Daniel Stewart said he wasn't in Pineville the night of the shooting and couldn't positively state his father did not any alcoholic beverages in his car under sharp questioning by Knuckles and the objections of the prosecution Stewart admitted his father lived away from his Daniel's mother and the rest of the family for over seven years The next witness Bob Madon who was Republican candidate for Sheriff at the time of the shooting testified he was called to the Pineville hospital that morning and found Dr R E Baird operating on a man who had been shot Madon said he then went over to the Bell County jail where Glenn Stewart told him that he had had to shoot the best friend he ever had Madon said there were black spots on Stewart's face but he couldn't verify that they were powder burns On cross-examination by Knuckles Madon repeated that Stewart told him I had to shoot him Pineville police chief Simon Brock UPI A dynamite explosion rocked the Kanawha County Board of Education Building Wednesday night The blast came about an hour after a citizens committee called for permanent removal of a controversial series of new textbooks There were no injuries but the explosion knocked out windows in homes across the street and inside the board offices A computer operator inside the building escaped injury Police described him as shaken but okay Police said several sticks of dynamite had been placed under a gas meter at the rear of the three-story brick ding The meter was blown loose but there was no critical condition today racked by pain and nausea but his internal bleeding was halted and doctors said he snowed some improvement Nixon has not lost the will to live and is fighting with a great
