E Everett was on the bench morning in co common pleas court as the first degree murder trial of Harry Pierpont opened following an un- successful attempt of defense at- to unbench him as the presiding judge In a three-hour hearing j day night held before Chief j Carl B Weygandt of the Ohio J supreme court Judge Everett was j cleared of bias and in the case Justice Weygandt ruled there was insufficient evidence for the removal of the jurist after he had analyzed testimony of four witnesses including that of Judge Everett and C Long counsel for Pierpont Pierpont accused slayer of Sheriff Jess L Sarber had filed an affidavit of dice charging that Judge Everett had a bias and against the defendant and in favor of Prosecutor Ernest M Botkin and two assistants and the state of Ohio COMMENTS OA EVIDENCE In handing iown his decision at the end of the long session which was held in the same room where the murder opened Justice gandt said it would not be fiable for a chief justice to un- bench a judge when the evidence does not substantially show that he could not serve fairly and im- partially in the case A proceeding such as this tice Weygandt said requires sub- stantial evidence to unbench a judge The evidence does not show Jn any substantial form that this judge has any In this case Justice Weygandt said the question narrowed to a claim of whether Judge Everett has
