Damages Against the Injunction Bondsmen The much talked court house question came up in Chancellor McCaskill's court at Ellisville Tuesday The nature of the case was to try the injunction which prevented the election commissioners from holding the election The board of super- visors represented by Hardy and Arnold being the complainants and the parties who got out the injunction the defendants sented by Witherspoon and Pack Now to a layman the whole smacks a little like court That the de- fendants and complainants are and have been all the way through of the same mind seems evident But be that as it may it can be said to the credit of Messrs Hardy and Arnold that they presented real argument in a forceful manner argument be- coming the position they filled in this case and their profession Arnold spoke against the tion and Pack for it Tuesday Wednesday morning the ar- gument continued Witherspoon made plea from the in- junction standpoint Hardy made the final argument against the injunction Wednesday after- noon The lawyers carefully ed the its constitutional and unconstitutional features from start to finish One of the points dwelt upon as tional was the manner of raising the funds for the new courthouse some claiming that the whole county must be taxed After the argument was con eluded Wednesday Judge the matter under con- until Thursday morning when he rendered his decision In this decision he sustained the Demur of board as presented by Hardy and Arnold dismissed the injunction case and allowed damages against the bondsmen of 8600.00 for Hardy and Arnolds fees in the suit Judge McCaskill took the ition that the grounds on which the injunction was allowed were without real foundation As we understood it this tains the election and it is now in order for the proper authority to count the vote and declare the results It will hardly be sible to pick a flaw in the ion as it is no doubt the nearest a legal election ever held in Jones It is hardly probable that the opponents of the will take an appeal in the face of present conditions as the position of the Supreme court is known on ilar cases A T Gieger et al Vs Gardner Co et al
