County for 150 Years LM dog track suit d Associated Press AUSTIN Two groups that failed to win a coveted parimutuel license for a dog racing track in Galveston County accused the Texas Racing Commission in court Monday of breaking the law Meanwhile the winners described their opponents as extremely poor State District Court Judge Scott McCown said he will probably decide the case Friday If the plaintiffs are right most of the Racing Commission should be in the pen If the Racing Commission is right they ought to be given medals by the gover McCown said The dispute is over the license granted in 1990 by the Racing Commission to Gulf Greyhound Partners Inc to build a track in La Marque The facility is expected to be one of the most lucrative dog tracks in the nation It is about 70 percent complete Lone Star Greyhound Park Inc and Galveston Bay Greyhound Racing Associ ation are challenging the Racing Commis sions selection of Gulf Greyhound a group led by Paul Bryant the son of leg football coach Paul Bear Bryant The two losing groups allege that the commission violated numerous laws in the process of awarding the license In numerous instances those standards were violated the parties were not accord ed said Lone Stars attorney Tim Herman of Austin Lone Stars major complaint is that the Racing Commission voted to award it a license in November 1989 and then six months later without hearing further evi dence emerged from a meeting and decided to reopen the contest for a license Under questioning from Herman Racing Vol 150 No 109 Daily 50 Cents Sunday kely Friday Commission general counsel Paula Carter said a taped recording of that closed session could never be found She said she threw away a tape marked with the date of the hearing but that the tape was blank When asked why she threw out the tape she said it was to avoid confusion Ms Carter also said she found nothing improper when she applied for a job as an assistant to Robert Johnson who was a member of the law firm that represented Gulf Greyhound and had just been ap pointed parliamentarian to the state Sen ate Herman also alleged former Racing Com mission member Hilary Doran had er communications with representatives of the competing track groups The entire character of the these pro was fraught with denial of due Herman said In videotaped testimony Doran denied any wrongdoing Attorney David Duggins of Austin who represents Gulf Greyhound said Lone Star and Galveston Bay Greyhound were extremely poor Their entire case is a series of vicious attacks reprehensible and without mer Duggins said Airline lawyers told to toe line By JIM BRIGANCE The Daily News GALVESTON District Judge Samuel Kent laid down the law Monday to airline attorneys telling them the suit against Amer ican by Continental and Northwest Airlines will begin in about a year Kent said the case will move for ward rapidly in the fashion for which he is known My only objec tive in this case is to move forward as expeditiously and as inexpensively as he said I will allow 40 depositions per side and 11 days for trial for each Kent mentioned several times his bulging docket of pending cas es and noted that in his 20 months on the federal bench he has heard cases I want to see us reach a prompt resolution of this he said The separate yet similar suits against American which were con in June claim Ronnie Palmer left and William Moody at the Falstaff Brew brewery will be demolished Old brewery being readied for wrecking ball By JIM BRIGANCE The Daily News GALVESTON Bulldozers are cleaning the area around deserted Fal staff Brewery and city officials said the build ings will be demolished in phases beginning early next year Ron Durst assistant director of housing said Monday the brewery will become a vacant lot early next year when demolition crews take a wrecking ball to the buildings Durst said the old brewery has attracted derelicts and crime for years He said there have been 18 to 20 fire calls at the vacant brewery since January sparked by vandals who burn the insulation off copper wiring which is then sold The place is dangerous its an eyesore and its just a nuisance having it Durst said The old building is dilapidated and all it does is attract derelicts and trouble The contractor has taken down all the cat walks and now they are bulldozing the brush and tires and stuff like that around the build ings Well have all five buildings pulled down right after the first of the The brewery is located off Market Street between 33rd and 37th streets It has been vacant for years and efforts to find other uses for it such as a new county jail failed Durst said Falstaff plans to save the brew erys vats for shipment to Hong Kong where they will be installed in a new brewery Fal staff beer is no longer marketed in the Galve ston area he said Durst said some 30 other buildings through out Galveston mostly residential struc tures are being torn down in the next The Daily News GALVESTON The Pride of Galveston gambling ship will be sold at a auction Aug 12 The ship has been tied up at Pier 12 since October the victim of bankruptcy and en gine problems not to mention still unresolved legal issues sur rounding gambling ship operations in Texas It was a combination of things that did them said Brian Et tinger Houston attorney for Pride Cruise Lines the ships owner They had a fire last July then the principals were threatened with indictment plus the bankruptcy and the inoperative boilers They couldnt see any light at the end of the tunnel They just phase of disabilities act By ROBERT HOUGH The Daily News LA MARQUE The second phase of the Americans with Disabilities Act dra changes hiring laws The second phase of the law which went into effect Sunday bars employers of more than 25 people from giving ment physicals and asking applicants if they have disabilities Jobs must be redesigned when neces sary to eliminate minor tasks that pose problems for people with disabilities Cindy Kegg director of supported employees for the Gulf Coast Center said many employers are misinformed about the act A lot of businesses might be leery about new Kegg said Kegg said employers at larger compa nies tend to have a better understanding of the requirements Some of the bigger places have had peo ple come in and train them about the she said Kegg said it remains a difficult fight to find employment for persons with Were going against a great many stereotypes about people with she said Norene Jaloway the Gulf Coast Cen ters director of employment services said employers can be skittish about costs involved with modifying the workplace Bui she said such costs are usually mini mal Jaloway said she has never seen an employer have to
