canvassed by the proper officers That it was tha in- tention of the law that it should be so perhaps true but we cannot agree that by the wording of the act such a correct The following is the ding of a portion of Sec 6 of the No bonds shall he issued in pursuance of this act nor shall the credit of the county be loaned to said Railroad Companies until a majority of legal voters of said county voting upon said question shall vote in of the same at an election to be called by the clerk of the Board of Supervisors or the sheriff of said county for that purpose There is nothing in any of the succeed ing sections which in any manner does away with the force of the above provision It is claimed that the two last sections ot the act change this but we do not so stand reading of them Those sections enly give to the towns of Rosendale jesco and Spring vale the right to exempt from the loan but they are not in any manner restricted from giving their voice against the whole project Our own opinion is and we believe the Court would so decide that the canvass be made by adding all the votes against the loan together and vice versa and then take the majority as it may come This would leave
