any other law of this state or bj any other rulo or regulation of tho treasury made in con- to law Sec 4 For tho purpose of securing a more full und system of among the officers of the fiscal de- ot tho state there bo ted a comptroller of tho treasury whose term of oHico shall bo throo years and it shall bo his duty to inquiry after all claims anc accounts of scription in favor of tho stato and require prompt payment of tho same and in case tho payment of any such claim bo resisted to place tho same in process of collection under tho charge of the attorney general of the state and hu shall perform such er duties and receive such compensation as shall bo proscribed by law Sec 5 Every payment of money into the state shull bo made on tho draft ofthe comptroller draun in favor of tho stato treasurer on tho person making and no payment into the state treasury shall discharge too liability to tho stato unless it bo made on tho dralt of tho comptroller as aforesaid And it shall bo tho duty ofthe comptroller to preserve a duplicate copy of draft and to keep an accurate record of its number amount date and name ot tho person upon whom drawn designating the fund to which it be- and to report the aggregate arnt of all such drafts to the auditor of state at the close of every week designating tho exact amount belonging to each fund Tho auditor of state shall keep an accurate ord of every such weekly report of tho comptroller and charge the amount of specifically to each account kept in tho auditor's office of receipts and ments of the state treasurer Sec 6 No money shall be drawn or out of the stato treasury or red from tho state treasury to any county treasury or to any other place for use or disbursement unless it be on the warrant of tho auditor of state drawn upon tho state treasurer countersigned and copy of warrant to tho county auditor to bo by him nnd a record by him kopt of tho number date and amount thereof Soc 9 No shall be received in- to or paid out of by a committee of tho general assembly or by a committee of persons not members ofthe general assembly appointed by resolution of tho general assembly And it shall bo the duty of tho governor whenever tho law or in his opinion tho public require it to appoint some competent and worthy accountant of tho highest ability and skill who in connection with tho tary of stato shall immediately without previous notice or intimation ot such in- tended examination and inspection pi to muke a thorough and competent of nil tho books records bonds securities assets and effects which are or should bo in tlie treasury and shall count all moneys in thu treasury and compare tho books vouchers accounts records with those ofthe ditor of stato and comptroller of tho ury all of which it is hereby made tho often is onco in every six months or oftener if the said judge shall deem it necessary without notice to any person to point in writing under the seal of said court a competent and trusty accountant party thereof bo- longing to tho state or any county or township or organized city or village iu this state shall convert to his own use or to tho uso of nny person or persons body corporate ui pm ty in any way whatever or shall uso by way of investment in any kind of stock land or merchandize or in any other manner or foim whatever or shall loan with or without interest to UHV company association or individual any portion of tho public ey or any other funds property bonds ps assets or effects of any kind received controlled or held hy him foi safu transfer or disbursement or in any other way or manner or for any other or if auy person shall ad- vise aid or In any manner participate in such every such act shull bo doomed in the law to bo an embezzlement much of the said moneys as aforesaid as shall bo thus used invested loaned ted or paid out as aforesaid which is by declared 10 be a high crime and meanor and upon prosecution by in and conviction thereof buforo any court of this state having competent diction such officer or porson or persons shall be sentenced to imprisonment in the penitentiary and kopt at hard labor for n term of not loss than ono year nor more than twenty-one years according to tho magnitude of tho embezzlement and also tu a line equal to double the amount of money or property so embezzled as aforesaid which fine shall as a judgment at law on all tho estate of tho party so convicted and sentenced and bo enforced to collection by execution or other process for the use only of thu party or parties whose money or other funds property bonds or securities assets or effects of any kind as aforesaid has beon so embezzled And in all such fino so operating as a judgment shall only be released or entered as satisfied by tho party in interest as aforesaid Any failure or refusal to pay ofer or to produce the public or any part thereof by any officer or other person undor this act charged with tho collection receipt trans- fer disbursement or of tho public or any part thereof whether belonging to tho state or to any county or township or organized city or ted village in this stato or any moneys whatever or any failure to coun to or to make and day of January 1859 and the semi-annual interest on the domestic debt ofthe state to become due on the first day of May and the first day of 1858 the eight hundred and fifty thousand dollars For the payment of interest on school and trust funds held by the state the sum of one hundred and forty-five thousand lars For the payment of the salaries of the transfer agent and registrer city of New act to establish an Asylum for the Education of Idiotic and ile Youth passed April 17 1857 Section 1 Be it enacted by the General Assembly of the State of Ohio That aeven of the act entitled an uct to lish an asylum for the education of idiotic and imbecile passed April 17 1857 be amended so as to read as follows Sec 7 No youth shall be admitted into said asylum to be maintained and educated therein at the expense of the state who are over fifteen of age or who are capable of at common schools but paying pupils of any age may be admitted at the discretion of the board Sec 2 That original President ofthe Senate April 12 1858 No 66 AN ACT To amend tha 17th 18th and sections an act entitled an act for the assessment and taxation of all erty in thia State for thereon according to its true value in money passed and April 13th A D 1853 Section 1 Be it enacted by the General Assembly of the State of Ohio That the sixteenth section of an act entitled An act for the assessment and taxation of all property in this State and for levying es thereon according to its true value in passed April be and it is hereby amended BO as to read as follows Sec 16 That when any person shall com- mence any business in any court after the day preceding the second Monday of April in any year the average value of whose personal property employed in such ness shall not have been previously ed on the assessor's list for taxation in said county such person shall report to the auditor of the county the average value of the personal property by him in- tended to be employed in such business un- til the day preceding the second Monday of April thereafter and shall pay into the treasury of such county a sum which shall bear such proportion to the levy for all purposes on the average so employed as the time from the day on which he shall commence such businesses aforesaid to the day preceding the second Monday of April next succeeding ahall bear to one year Provided that if the person so ing his shall present a bona fide re- from the treasurer of any county in this state in which such capital had been previously listed and taxed tor the amount of the taxes assessed and by him paid on the same capital for the same year then and in that case it shall be a receipt from paying taxes again on such Sec 3 That section number seventeen of the act aforesaid be ed so as to read as Sec 17 That when any person commence or en- gage in the business of dealing in stocks of any description or in buying or shaving any kind of bills of exchange checks drafta bank notes promissory notes or other kind of writing obligatory as in the fifteenth section of this act after the Hy preceding the second Monday in April in any year the average value of whose personal property intended to be employed in such treasurer of state or any county treasurer shall pay out any public money in any manner than is pro in sections 13 and 14 of act every such treasurer upon conviction thereof before any court having cogni of tho same stall forfeit and offense a fine not less than twenty every Monday in April thereafter and shall pay into the treasury of such county a sum which shall bear the same tion to the levy shall be i Speaker of the House of Representatives M President of the Senate April 12 1858 AN ACT To provide for the Semi-annual Collection of Texas SEC 1 Be it enacted by the General Assembly of the State of Ohio That each person charged with any tax with any tax duplicate in the hands of any county treasurer may at his option instead of paying the whole amount of the taxes with which he stands charged by the twentieth day of December as heretofore required pay to said treasurer on or before the said twentieth of December one half of the tax for the then current year with which he so stands charged and the remaining half thereof on or before the twentieth day of June next ensuing Sec 2 In every case when the amount taxes charged on the tax duplicate in the hands of any county treasurer against the property of any person shall be paid in installments as authorized by the ding section each of such payments shall be deemed to have been made on the eral taxes for the different purposes so changed on such duplicate and an equal prorate portion of the whole amount of each ofthe so charged shall be ried to the credit of the same 3 It shall be the duty of the ty auditor to set down the amount of es charged against each entry in two rata columns one half thereof in each column with a sufficient blank space at the column to write paid and when payment of either half of such taxes shall be made the treasurer shall write in the blank space opposite the same the word paid Sec 4 If any person charged with any tax on the Ux duplicate in the of any county treasurer for collection shall not pay one half thereof on the tieth day of December next after the same shall have been charged on such duplicate or shall not pay the the of such tax on or before the twentieth day of June next thereafter the county treasurer may charge such delinquent with five per tum on the sum so payable on or before each of said days as a penalty for the non payment thereof and may collect said alty for the uso of the treasurer as a ty for such collection together with the tax charged to such delinquent and which he shall have failed to pay as aforesaid by or otherwise in the manner pre- scribed by the nineteenth of the act prescribing the duties of county urers in all oases where the half of any tax other than taxes upon real not be paid on or before the twentieth day of December the whole of the taxes for the current year so charged shall be due anil collected as in case of delinquent es Sec 5 Bach county shall on or before the Monday of February in every year settle with of his county fur collected on or the twentieth day of December next pre- ceding such settlement and he shall also on or before the first Monday of August next preceding such February settlement settle with the auditor of his county for he taxes charged on his duplicate not col- on or before the twentieth day of December previous and settled for as n before provided Sec 6 In making every such nent the county auditor examine the tax duplicate and ascertain rom the entries thereon of taxes penalties and interest paid in whole or in part and rom such other sources of information as may be in his reach the true amount col- by the county treasurer on account of each of the several taxes charged on such duplicate and the amount remaining n the hands of such treasurer belonging to each and ahall give to such treasurer separate certificates of the several sums 2 Each county treasurer shall within ten days next after he shall have made such settlement with the courtly ditor required by the fourth September next after bis ion his office shall be heie to be vacant Sec 13 If one-half of any tax charged any lands or town lots shall not be paid on or before the twentieth day of De- cember in each year or collected by tress or otherwise as hereinbefore same shall be charged on with thirty per cent penalty and interest and with said penalty and interest snail be payable on or before the twentieth day of June next and if not theit paid together with the one-half of said tax due on or before said twentieth day of June the same penalty and interest shall be charged on said last half of lax and the whole together shall tute the delinquent tax on seen lands or town lots to be dealt with and collected in the manner prescribed by law And if such delinquent taxes aud penalty together with the one-half of the taxes charged on such real estate for the current year not be paid on or before the twentieth day of December in each year the said quent taxes and the whole ofthe taxes for the current year shall be doe and be collected by the sale of such real estate in the prescribed by law and in case the first half ba paid on or before the twentieth day of De- cember as herein provided but the last half thereof falling due on or before the eth day of June in any year shall not be paid on or before said named day then and in that case the same penalty shall to said unpaid half of such tax and the same shall be treated as delinquent tax as n provided Sec 14 The auditor shall annually during the of August make out and record in a book to be provided for hat purpose a list of lands and town Iocs returned delinquent by the treasurer same officially See 13 The county auditor shall annually on or before the first day of October deliver to the county treasurer the duplicate of taxes now required by aw to be made out Sec 16 Nothing in this act ed shall prevent the sale of land for- es heretofore delinquent on the Monday of January 1859 agreeably to the law now in force prescribing the ies of the county auditors Sec 17 Section twenty-nine of the act prescribing the duties of county aud sections 3 and wenty three of the act pre- duties of the county passed March 15 1831 sections two three and five ofthe act to amend the aforesaid act passed January 3 1846 and section one of the act relating to the duties ofthe county treasurers passed March 2 1846 are
