After appeals fail Gilmore shot to death POINT OF THE MOUNTAIN Utah UPI A Utah State Prison firing squad killed Gary Gilmore with four shots through the chest shortly after sunrise today in the United States first execution in a decade Lets do it Gilmore told Warden Sam Smith after the rifle team lined up behind a gray canvas 25 feet away from the chair in which he was strapped The execution took place minutes after three federal judges in Denver and the US Supreme Court lifted the last legal barrier to the killers death A BLACK corduroy hood was placed over the slayers head and the firing squad pumped a volley of 3030 slugs at a round white target pinned to his chest at am 18 minutes after dawn The warden gave the signal and then I heard three noises in rapid succession said agent Larry Schiller who was invited by Gilmore to witness the shooting Gary moved His head turned slightly to the left but he stayed erect Red blood then emerged from the black and onto his white slacks The bullets tore through the con mans body through the leather cushion and back of the captains chair through P inch sheet of plywood and into a pile of sandbags THE DEADLY ended a 2A month saga in which Gilmore finally won his wish to die with dignity like a man He was executed for the slaying last summer of motel manager Bennie 26 during a holdup in Provo Utah He had also admitted a similar slaying the previous night during a gas station robbery The firing squad consisted of a leader who gave the signal to fire and five riflemen four shooting live rounds and one a gun loaded with a blank Gilmore was executed after a long night of legal maneuvering that ended only minutes before dawn when the 10th Circuit Court of Appeals in Denver lifted a stay of execution granted seven hours earlier by US District Judge Willis W Ritter AT THE SAME time US Supreme Court Justices Byron R White and Thurgood Marsha rejected a last minute request by the American Civil Liberties Union filed before the 10th Circuit acted Ritter ordered the execution Gary Gilmore stopped the third stay in the Gilmore case after hearing arguments by ACLU attorneys that taxpayers funds were being illegally spent because Utahs death penalty law was unconstitutional The judge and US Marshal Roy Butters personally drove to the prison to deliver the stay of execution order to Smith after the judge announced his ruling at am But state attorneys immediately went to Chief Judge David Lewis of the 10th Circuit who lives in Salt Lake City LEWIS CALLED an emergency session of the court in Denver and flew across the Rockies with Utah Attorney General Robert Hansen four of his assistants and an ACLU attorney in tow When the circuit court overturned Ritter Attorney General Hansen called Warden Smith and Gilmore was driven by van from the prisons maximum security unit to a storage building formerly used as a cannery Schiller who had bought the rights to story for said he and three other witnesses invited to the shooting were told at seven minutes to eight that the condemned man was being moved to the execution site He said they previously had been told that Fourth District Judge Robert Bullock had budget President Ford today urged Congress to hold the line on domestic spending but appropriate more funds for defense hike Social Security taxes and in a surprise cut income taxes not only this year but again in 1980 1981 and 1982 All told those four tax reductions would total billion Ford said the cuts are needed to offset the rise in effective tax rates that would wise occur as inflation and BARCELONA Spain UPI A Spanish freighter sliced into a US Navy launch carrying more than 100 sailors and marines back to their ships from shore leave today The US Consulate said 20 Americans were dead and others were feared missing Frogmen searched the harbor for more bodies As the launch sped toward the helicopter carrier Guam and the amphibious dock ship Trenton the Spanish freighter entered the harbor SURVIVORS SAID the returning crewmen were huddled in the boxlike open launch and saw the freighter only seconds before it sliced into their vessel Many of the American sailors and marines were wearing heavy coats that made it difficult to swim the several hundred yards to shore Forty men were hospitalized with injuries or to recover from the effects of nearly drowning The spokesman said noon Thursday Carter will propose his own tax cuts and its already assumed the Democratic Congress will ignore Fords tax ideas and approve Carters The incoming president also is expected to ask higher spending on things like public jobs and public works programs which Ford would trim Carter also will make some sm all dent in defense spending Nonetheless Fords imprint and proposals are likely to hold for scores of federal programs The Carter team already concedes it wont have the time to suggest as many revisions in the complex budget as it might like its revisions are due on Capitol Hill
