DISTURBING Decision of the Federal Supreme Court in a Montana Murder Case Which Will Be Likely to Give Many Prisoners Their Liberty State Has Jurisdiction Over Crimes on Reservations Ex cept as to Wards the jurisdiction of the state courts and if released those courts could take jurisdiction of and try and determine their cases on their merits If the evidence to convict them cannot be reproduced they would con sequently go free The Draper case so far as the results are concerned is by far the greatest criminal case ever tried m Montana THE CASE DISMISSED Great HELENA Mon Dec telegram from Washington states that the United States supreme court had reversed the Draper murder case which was ap pealed from this city The reversing of the case gives Draper a new trial and not only that but it takes the case out of the United States court and throws it into court One of the points in the appeal was that the United States court had no juris diction in the matter and it was on this point the new trial was Not the Proceeding It is the first time the United States supreme court has ever had this juris diction matter brought to it and in handing down the opinion it did it es a precedent which is in con with the federal courts in such matters It will be remembered that Pleasant Draper about a year ago shot and killed Turner on the Crow Indian reservation Both were employed at the agency at the time Draper was tried inthis city before Judge Knowles in the United States court found guilty and sentenced to be hanged His attorneys appealed to the United States supreme court for a new trial one of their points being that the federal court had no jurisdiction to try the case that the only cases which courts can try are those in of Superior Cannot Tax Northern Elevators WEST SUPERIOR Wis Dec I Judge Vinje in circuit court granted the defendants motion for a dismissal in the case of J S Bishop against the assessors in the city of Superior Bishop instituted mandamus proceedings to compel the assessors to place upon the tax rolls of the city the elevator plant of the Great Northern The case was on trial for four days and the plaintiff had finished its question In the natural order of things this subject coming under the head of foreign relations would occupy a most prominent place in the very tbe ginning of the so might expected to receive early treatment at the hands of the president Still a Gap in the Message There is still a gap in that part of the message however notwithstanding several efforts have been made to close it up for the varying phases of the campaign now in progress iu Cuba have made it necessary to change consider ably the views the president and Sec desire to lay before con gress in that connection and probably it will not be until the end of aud at the very last moment tnat the missing paragraphs will be supplied Of course any expression of opinion to the nature of the presidents views respecting Cuba are only speculative at present but so far there can be found no warrant for the assumption that he has determined upon any decided change in the policy tp be pursued by the administration in fhis matter Yet this government is only temporary and the people want to be annexed to the United States The members of the government are pledged to it and the present constitution of the republic expresses this expectation So it is the general belief that the matter should be decided at an early date if possible THE NEEDS OF CANADA RECEIPTS AND EXPENDITURES St Gazette the Government to Consider Them has for years transacted the business and acted in the capacity of a confidential adviser for the Mille Lacs tribe of Chippewa Indians received a letter from Head Chief stating that he had been notified that the Indians would receive a payment of the an due them on Monday The annuity amounts to per head including squaws and children Unpaid For Six The Mille Lacs Indians have not been paid annuities for six years and it is thought that the reason for withhold ing payments was the desire of the de to induce the Indians to re move to the White Earth reservation and accept land in the worst wreck ever known on the North ern Pacific railway in point of damage to track and rolling stock Richard C Arrested In New York on Forgery Charge NEW YORK Dec arrest which the police believe to be a very import ant one was mode in the general post office here The prisoner is Richard C Monks alias Wellington Thornewaite who is wanted for forgery in Bay City Mich and if the contents of his pock ets show anything he has been operat ing on a very extensive scale There were found on him biank checks on at least banks in states all the way from Texas to Maine He alo carried a punch such as
