C Byrd campaigning here with Jay Rockefeller told reporters that George McGovern will not win the election and at this point he would have to overcome in- superable odds He declined to speculate raises several unusual possibilities in state politics Gainer a Democrat was seeking re-election to the office he had held since 1961 and which he won in three general sent to all of the Democratic tions His Republican opponent is John Gates Gov Moore's chairmen of the counties and commissioner of finance and administration State Democrats could under the law pick another candidate for auditor and conduct a write-in campaign an unlikely in view of the short time remaining in the campaign But that does not mean Gates wins the office automatically He must get more votes next Tuesday than Gainer or any write-in candidate If he does his term will start next Jan 15 If he does not the next governor who will take office next Jan 10 will appoint an auditor to serve from Jan 15 until the general election in 1974 when an auditor will be elected to serve two years In the meantime Gov Moore can appoint an auditor to serve the rest of Gainer's term and there are no restrictions on the governor either in the Constitution or the law The interim auditor does not have to be a Democrat as Gainer was and the appointment does not require the rence of the State Senate advised that fee
