1796 A WEEK HOME DELIVERED A COPY Clemency For Man Jailed In 51 Killing Serving Time In Murder Of County Deputy ALBANY A man convicted In 1951 of second degree murder of Ontario Counly Deputy iff Jack Fennell yesterday was a beneficiary of Governor use of the executive clemency traditionally extended at Christmas The man is Anthony J Napoli 33 serving a to life tence at Attica Stale Prison The governor's action means Napoli will be eligible for parole in June 1986 lie would not have been eligible until about 1978 without the clemency act Rockefeller said the fation was extended upon recommendation of the Slate Parole Board Napoli was one of four en- listed men from Sampson Air Force Base who were chased by deputies after the men had robbed an attendant at a service station in Canandaigua on June 4 1951 Tile car in which the fcur men were driving was stopped by Deputy Fennell OH Route 5 and 20 just east of the State Police substation As the deputy got out of his car to approach the airmen he was shot in the abdomen by Cpl Joseph Me Cretton Deputy Arthur Scammell ar- rived just as the four airmen were driving away He found Fennell and radioed for help for the stricken man and began chasing the airmen He edly shot one of the young men after the chase which ended in Geneva City when the car en by Napoli crashed into a tree after hurtling through a road block set up by Geneva police During the gun battle which after the crash Napoli suffered a slight wound in the head and another of the men Sgt Peter Gannon was shot in the leg reportedly has had a good record in He has served as a teacher in the program al Attica Stale Prison No commutation was ed to the other three men who were involved in the robbery and shooting Turkeys For Mississippi JACKSON
