Arizona Supreme Court reversed it self in a criminal case Monday and granted a new trial to Joel Guidin of Globe Guidin is 3050 year prison term following his con viction last spring In the Gila Coun ty Superior Court on a charee of HUM He was defended by George Senner and Sam Lazovich Miami attorneys who also represented him in the Supreme Court Reversal by the supreme court of a superior court judgment in a criminal case not only is seldom done but it is almost unprecedented for the high tribunal to grant a motion for rehearing to a person convicted of a The court previously had review ed conviction and in a 2 to 1 decision had affirmed the judgment of the Gila County Su Court but a rehearing mo tion was filed and after considera tion of It the court allowed the motion and in a 2 to 1 decision ruled that Guidin did not receive a fair and impartial trial Justice Joseph HMorgan of the new majority opinion which was concurred in by Justice Arthur T La Prade Chief Justice H C Stanford dissented holding to the original decision affirming the conviction In the first ruling Justice La Prade had dissented The court warned In the new opinion that It is a fundamental principle of our law that defend ants are entitled no matter what the charge may be to a fair and impartial trial If prejudicial error exists whether properly assigned or not and it cornea to the attention of this court it should be considered Justice Morgan wrote In a case like this where the conviction must of necessity depend on the practic ally uncorroborated testimony of a child great care should be exercis ed to see that no is al lowed to creep Into the trial The court did not go into detail as to what constituted the dice but indicated it pertained to the testimony of a witness and other matters Justices
