are in the travel business as everyone knows will be taking off in midSeptember for a visit to Southern Ireland and England Rep Cain Defends Judicial Reform By STEVE CRAW Staff Rep Marshall Cain R yesterday defended a pro posed judicial reform a against charges by House candidate Mrs Irene Rudnick that it takes power away from the peo ple Cain called the objections to a provision in the reform amendment minor and efforts to change it would defeat the entire judicial reform measure The controversial revision is in Article V Section P and replaces specific nam ing of county and state of with a generalized description of officers and duties It would eliminate the identification of such of as county sheriff coroner clerk of court and solicitor The amendment goes be fore the voters for approval in November and is part of the continuing revision of the states 1895 constitu tion Mrs Rudnick said at a Jackson meeting last week end that the new amendment would give the General Assembly the power to stip ulate how the county cers would be selected and the setting of their pay Cain admitted the legis lators would have the power but said the provisions of the 1895 constitution pro vided no protection of these offices from legislative tampering either But I can assure you that no one in Columbia is con templating getting rid of the office of sheriff or any other said Cain Why that would be po suicide added the Aiken lawmaker Cain expressed fears that the recent argument over the section would defeat the entire judicial revision which is the product of three years of study by a gov committee The controversy cropped up last week when Richland County Sheriff Frank Pow ell and Fifth District So John W Foard of Columbia took issue with the section Their demand that Gov John West call the General Assembly back into special session to change it was rejected by West Saturday Powell began a campaign yesterday to get the South Carolina Sheriffs Associa tion to help defeat the meas ure in the November refer The revised section re places a listing of the of and duties with this paragraph The General Assembly shall provide by law for the selection duties and compensation of appropri ate officials to enforce the criminal laws of the State to prosecute persons under such laws and to carry on the administrative func tions of the courts of the state The Attorney General shall be the chief ing officer of the State with authority to supervise the prosecution of all criminal cases in courts of record Cain observed that the revised section clears away unnecessary language and a cluster of amendments added onto the bulky con He stated it is part of the effort to make the con modern and flex ible Turning to charges that the section would infringe on the duties city manager said that he had received a good many comments concerning iSre COUNCIL Fife Rogers Seeks To Calm COG Foes By STEVE CRAW Staff Reporter Wayne Rogers acting director of the Council of Governments of Aiken and Richmond counties COG came to Aiken today to smooth ruffled feathers over Aiken Countys forced membership in the inter state council Just prior to speaking at a luncheon of the Board of Realtors at the Commercial Hotel Rogers said he came not to debate but just to provide information on the COG He said he had been urged by members of the COG to come and try to allay fears that have been aroused in Aiken over joining an Au gusta dominated COG I leave debate of the issue up to the policy mak ers of the council of govern ments said Rogers The COG at present is made up of six local govern ments the city of Aiken New Ellenton North Augusta Augusta and Richmond County Aiken County has been un der pressure from the fed eral Department of Housing and Development HUD to join the COG but local leaders have been reluctant to do so HUD officials say partici pation in the COG is neces sary to coordinate planning between Aiken and Rich mond counties They have backed up their reasoning with the threat of cutting off federal grants and aid if some sort of arrangement is not reached At the last delegation meeting Aiken lawmakers endorsed an alternative to the proposal of establishing the COG and giving it its own planning staff Jim Hammond executive director of the Lower Sa vannah Regional Planning and Development Council told the delegation they could join the COG But in stead of setting up another planning staff they could use bis staff Under this alternative proposal Hammond would serve in a dual role as exe cutive director of the Lower Savannah Agency and of in coordination for the COG This said Rogers is un acceptable to the two plan ning agencies in Georgia just as it would be to Aiken County for this coordination task to be handled by one of the Richmond County planning agencies The director of the COG said Rogers cannot have such a dual role He must be a full time director re sponsible solely to and paid by the COG Rogers is on loan from the County Planning Commission where he used to be a senior plan ner He said in his contacts with the HUD regional office in Atlanta it was pointed out that the key to resolving the dilemma is for the director to be responsible strictly to one agency and not to er planning agency at the same time The fear is that such a dual director could conceiv ably put in more time for she county h e originally serves said Rogers HUD officials says Ro gers have been informed of the alternative plan en fay Aiken and are waiting in hopes that local leaders will straighten out the conflict If they dont HUD will step in at a later date to mediate according to Ro gers We want to get people in the two counties talking to each other before that would have to happen add ed Rogers The councils statement was presented in advance of testi mony before the 108memfaer GOP Platform Committee by the three council members Chairman Herbert Stein Ezra Solomon and Marina N Whit man The committees draft platform goes to the Republi can National Convention which opens here Monday The councils statement sup ported in effect President Nix ons call to Congress for a billion ceiling on budget outlays for fiscal 1973 and bis warning that he will veto programs that he considers to involve ex spending The key here is the federal budget the council statement said and our effort must be to prevent an explosion of spend ing which will make inevitable both more inflation and more taxes The council painted a rosy picture of the economic outlook declaring that the economy is rising at an extraordinary rate in the most recent quarter this was twice as fast as nor mal The gains promise a sub further reduction in the OD per cent rate of unemploy mem the statement said The economy is well on its way to a healthy combination of high employment and rea sonable price stability But we are not there yet The near term task is to prevent a resur gence of inflationary pressure while keeping the economy ris ing
