courteous enough to we all settled down to tbe business of sight seeing Keith who has decided that cars ride DAMAGE SUIT BROUGHT TRIAL Rep Judicial Conclave At Creston On July 3d Elsewhere in this issue Is published the official call for the republican judi cial convention which will be held at Iowa on Thursday July 3rd The convention will include delegates from seven counties in this part of Iowa which go to make up the third judicial district of Iowa The seven counties of the district will be represented by 75 delegates at the convention Delegates to ths conven tion win be named at the county re publican conventions to be held June 28 The counties to the laird district and the number of delegates allowed each are as follows Adams 3 Clarke 9 Decatur II 10 Taylor defendant in which the plaintiff Change Of Venue From Union County County Sari McClelland has received from the county clerk of Union county s transcript of the rec nomination three Judges to succeed the present judges terms es pire December 31 1330 The present judges In the seniority are Eon Homer A Fuller of Mt Ayr Hon A Ray Maxwell of Creston and Hon H H Carter of Corydon So far as these three will be candidates before the to succeed them selves and there is little possibility that they will meet any opposition in the convention Nominees of this conven tion will be voted upon next November in the general Lewis Evans darks B Hawkins Decatur Frank F Ful ler James R Locke Taylor and Wayne Wesley Brokaw Faces Car Theft Charge Wesley was arrested near last week by Sheriff C E Rubin on a charge of having stolen a tudor model Ford last December at Parker South Dakota Some time ago Sheriff Rubin became suspicious that tine car which was driven by Brokaw had been stolen The Sheriff noticed last December that Brokaw was driv ing the car under a South Dakota li cense number and that shortly after ing a single license plate Further in proved that Mr Brokaw Is asking damages from Union County The case has been transfer red to ASSESS count en s motion by the plaintiff for a change of venue the motion having been granted by Judge Homer A Fuller In all probability the case will be tried in Adams county at the nest term of the district court The case is one which in all pro will attract considerable at tention as there are many legal points Involved and the case is indirectly eoa with the George Gibson mur der trial which was held in Union county a few years ago George Gib son having been found guilty of the murder of Sheriff Fred Ceilings of Union county Emma C Gibson the plaintiff in the case to this county for trial is said to be the sis of George Gibson who is now serving a life term for man slaughter in connection with the Col lings murder Mrs Gibson ss damages Union county on the grounds that Qie county unlawfully took for road pur poses certain real estate owned by her near Thayer in the east part of Union county The plaintiff claims thet the land in question WAS composed of some ten acres formerly used as a right of way by the C B Q Railway Company and it was as toe abandoned right of way tae same be ing a strip of land about 100 feet wide and one mile long The plaintiff states in her petition that upon this eban right of way there was about 29000 cubic feet of masonry consist ing of culverts piers and abutments very much like a car with a flat are to sates trimmed No words can describe the magnifi cence of Royal Gorge end just as we this interesting scenic beauty passed the Colorado State tiary where the big riot occurred and this had a sobering effect It stands as sad as the rocks which form the background All alone tnis Gorge menacing rocks and one wonders how they are held in place and why they do not come tear ing down the sides crushing everything In their path Along the route we see the Hanging Bridge the highest bridge in the world and the beauties of the river below us All suffered more or less depression ss we to the Continental we in the observation ear are all keyed to the exquisite beauty of scenes It is worse than a three ring circus for a few jumps more or less missed do not matter but when you are missing beauty spots which are flying by and will never meet your vision again it really hurts Your neighbor on your right has seen some thing you missed one on the left is disconsolate because you have miss ed that waterfall that particular turn in the stream that glint of crimson on the formation but you MLW a wonderful Jot at that I tried to imagine an Iowa mother calmly fringing up her clothes while brood of little children poised perilously on s precipice and waved frantically at the patting ears 3ia fact I imagine any Iowa family living out here ia this country through which we ing at a house half way sights which are familiar to you from post cards and railroad folders Besides that we had chicken dinner for fifty cents and that included a delicious des sert That after diner meals for two days was about toe most wonderful thing that could happen We pulled out from Salt Lake City crossed the big briny pond and for miles we crossed the salt Holds with a growth making a pitiful attempt to appear upon and took possession of said abandoned right of way and converted the same to a public highway known at this time as a part of federal highway No 34 Plaintiff further claims that she filed with the board of supervisors of Union county a claim for the property taken and that the said claim was disallowed The defendant Union county has filed demurrer to Mrs Gibsons peti tion In which they state that the court has no jurisdiction for the following reasons that it Is an action against Union county a political subdivision of the Stata of lows and can not be sued in an action at law that the statutes do not authorize a suit against a county for damages such as the case at bar and without specific statutory authorization such an action can not be maintained and that the facts stated in the pleading do not entitle the plaintiff to the relief demanded Union county further states that under pro per proceedings the board of super visors duly condemned the real estate described In the Died Suddenly Monday At His Home Here Harrison of Moines are the architects Nichols Marten of Des Moines are the contractors for the main building Dean Rogers of this city holds the contract for Taylor County Board Orders Vote Recount At a meeting of the board of super visors of Taylor County Monday a mo tion was passed ordering a recount of the primary election ballots for the of fice of Republican state representative and one supervisor district hi that county There is in the Taylor Republican contest as Richard Cox spile Is this was the defatted candidate in prl count by Or C O of Gravity by 63 votes The campaign to the primary for this of Sice in Taylor County devel oped some rather literature One piece of literature printed and signed by Local Dr Heed for Representative Club of Gravity Iowa brought forth considerable com ment during the campaign This par circular concerned the truck which the Heed claimed Mr Cox supported by a yea vote when the was before the house on March 19 A circular or hand was printed that was purported to be a reprint of page 857 of the 1929 journal of the house On the circular Mr Coxs name WES printed In heavy black type as one of the 61 who voted aye on the bin However an examination of the house journal shows that Mr Coxs name appears very plainly among the 38 who voted no on the This very unethical and unfair method of campaigning has been the subject of considerable discussion among the voters of Taylor county There is supposed to be a statute in Iowa prohibiting publication of such literature during a campaign unless With a suddenness that left our com munity stunned Monday morning came the almost unbelievable news that Ed Vernon had passed away about Before the at his home on Grove Avenue Montra played a Prelude and after had been received the orches played for the recessional rive children Local Churches Hold Day Exercises The Childrens Day exercises of the Federated Church were presented Sunday June 15 in the form of aj pageant by the children assisted by several of the older folks The name of the pageant was What the Church Does for its Children and Vehna Schaffer took the part of the Church Glenna Lewis was the Guard ian Spirit of Childhood and Virginia Scott was a Page The Church called in the various branches of the Church such as the Primary department Jun ior Department Girl Reserves Boy Scouts Spirit of Missions Isabel Parenthood Mrs Ruth and a group of young peo ple who had the church this orches day morning r Vernon arose usual ate a hearty breakfast and told to the garage and have a new casing put on and would return the car at once as it was to be washed and clean ed Mr Vemon want to his work at in the Childrens Day Program at the Christian Church Sunday June 15th consisted of a pageant The Pathway to Senice and some special the bank but complained of not 5hureh was Dutifully decorated and the costumes worn by the children were very clever some of them representing birds butterflies and flowers The tiniest tots took the parts of children who intermingled with the butterflies and flowers Dur ing the pageant the choir and a quar tet furnished some special music and at the close of the program the of fering was received At noon there was a picnic dinner in Grove Park for the children who took part in the ing well and told his companions at the bank that he believed he would go home for awhile He drove home in the car loosing very ill when he arrived at the house Mrs Vernon called a physician put nun to bed and the end came in about fifteen minutes following an acute heart attack For a number of years Mr Vernon had been under a heavy nervous strain but had been feeling exceptionally well lately and told the doctor a minute be fore he died that the day before he had never felt better in his life He had never had an attack of heart trouble before j as he was familiarly known by ail wili be greatly missed in the community He was devoted to hii family and home a loyal a kind and helpful neighbor loved by alt who knew him We join in extending j sympathy to his bereaved family Edwin McPherson Vernon was born at Iowa January 9th 1875 and died at his home in Corning Iowa June 16th 1930 aged 55 years three months and seven days He was the sen Carlton Hulet Vernon and Mary Louise Jones Vemon he was one yesr old as with his father and mother to Adams county where he resided on a farm be tween Brooks ssd In 1S7S the returned to where his father had the presidency of the Mahaska County Bank of Oska loosa In 1899 he moved again to Corn fee resided death Vernon casss of Quaker stock and when a student of Pena Col lege joined the Quaker church Later he joined the Methodist church at Corning In 1903 he was married to Lilian D who survives him After his marriage he transferred his member ship witn his wife to the Presbyterian Church of Coming of which he has been a faithful member Besides his wife he leaves three children Mary at home Dorothy who has just graduat ed from High School and Carlton 8 student in the Engineering Department of Iowa University Another son died in infancy His mother died in 1887 and his father in 1920 A sister Cora Catherine died in June last year He Is survived by another sister Mrs Lena and husband Walter G Howard and nep hew Carlton Vemon Howard of Ar Park Iowa Also one uncle Wil bur M Jones his could be held responsible for publish ing and distributing such one B a petition or in which has filed by Ida Ceilings administrator of the estate of Fred deceased Mrs in her petition states that on 10 1923 she brought an la the district court of Union county claim ing damages against George Gibson On trial of this case judgment was rendered in favor of the plaintiff in the sum of and a lien of at was issued established and confirmed against the lands and pro of George Gibson and at this time of the judgment remains unpaid Under these conditions the in Mrs claims that the plaintiff has no right or title to the premises described in her petition nor to the funds paid to her by Union county by reason of the condemnation of the said real estate and that the in lien and claim is to the claim of Mrs Gibson and there fore the intervener prays the court to dismiss the plaintiffs petition Union county and that the court defendant Mrs Gibson to pay the iri the which she received when the laad was condemned The case is one which no doubt will attract considerable attention and con all of the propositions involved will require considerable time for trial during the campaign Complete Totals 155372 15W11 The ANDREWS MEW BOARD MEMBER At a special meeting of the Corning School Board Monday evening K C Andrews was elected as a member of the board to fill the vacancy made by the recent resignation of Dr M B Dr Latimer wes elected last spring ior s three year term and Mr Andrews has been appointed to fill ths until ths rdg ular school election greetings his absolute Integrity and unassuming ways endeared him to the whole community and his death wili be sincerely regretted The funeral was held from the Fed Church at Corning Wednesday morning June 18th and the body was taken to Oskaloosa Iowa for burial where the Masonic lodge had charge of the services Few Candidates File Expense Accounts According to the provisions of the Iowa statutes all candidates who par ta the recent primary elec tion are required to file within thirty days after election an expense account with the county auditor Up to Wednesday afternoon only six of the numerous Adams county candi dates had he completed his law course ir Mr Bisler is a son of Mr and Mrs John Bixler residing west of Corning and since September 1928 he has been associated in the law Corning with Allie M Fra zier Mr Bixler was graduated from the local high school in 1922 and com his law studies at the University of Iowa in June 1928 Paving On 34 WiH Soon Be Completed With favorable weather for six more days Adams county will at the end of that time have her first completely paved highway east and west across the county Reed Wheelock who have the contract for the oa No 34 east of Corning have been push ing their work to the limit and at this time only about one mile remains yet to be paved The rains during early part of the week slowed up iho work considerably as the high water at Prescott kept the trucks from SAND ENTERTAINED BY LOCAL LODGES Boys Gave Concert On Tuesday Evening A large crowd gathered at Central Park in evening is greet the Odd Fellows Boy Band of Mason City which appeared here under the auspices oE the local Odd and Rebekah lodges The program had been advertised to start ai bat oa account of the late arrival of the band and lodge officials from Cres ton the program did not get under way until nearly oclock There were seventeen boys in the band which ap here Wednesday evening and they travelled In a large bus carrying their own bedding and cots their arrival here the boys were served a fine supper by the ladies of the Re bekah lodge The Band remained hers over night camping in the Odd Fellow ledge room The Band was accom by Grand Master F A Rogers of Sioux City W J Edens of Mason City a member of the Soars of in struction A W Stabbs superintendent of the Odd Fellow Home at Mason City and Professor Karl Bohlen tor of the band A meeting or the Odd Fellow lodge was held preceding the parade and band concert at which time the ceremonies were under the direction of Andrew man of the committee on arrange ments Mr Peterson introduced past Grand Master Dan Gunn of Red Oak who was ia charge of the remaining activities of the evening The public program opened with a parade headed by Mayor W A Mc Kelvy and the state lodge officers fal lowed by the Boys Band Odd Fellow members and Rebekah members The Corning Band also participated in the program The parade ended at Cen tral Park and was followed iy an eve ning concert by the boys which was very the large ence Odd Fellows at Mason City is one of the finest la the At the present time the home is care of forty boys girls and 143 adulis The home is financed by assessment made against lodge member in the state and only children members or members themselves are admitted to the home The Odd Fellows maintain sixty eight such homes In the United States and Canada The Iowa Home was or and dedicated in 1903 and since that time nearly 1000 men wom en and children have been cared for by the Iowa Odd Fellows endowment fund Children are kept at the Home until they are eighteen years of age and then they are sent out Into the world fully equipped to make their own way The home is now valued at and is entirely free from debts There are now 583 I O O F lodges In Iowa with more thaa 100000 Odd Fellows and as mem bers Corning was pleased to act as host to the members the band and the state officers of the lodge and the vis as highly expressed themselves pleased with the welcome ing their regular hauls frora visiting Odd Fellows and from surrounding towns Two Cars Collide At Road Contracts Awarded On New Cromwell School 12j of the Cromwell Consolidated Knool dist rict awarded the contract for their new building which is to be construct ed at Cromwell this summer A recent bond issue upon favorably by the tax payers of the district will furnish the money to construct and equip the building The directors are feeling quite elated over the fact that they have been able to secure contracts which will allow them to carry out all of their plans using the best of mater ial and still leave enough finances to properly equip the building The general contract was awarded to Hay Kennedy of Bedford Campbell and Clark of Farragut Iowa were giv en the plumbing and heating contract and Donald Varney of Exira secured the contract for electric wiring A Buick touring car driven by F A j Brokaw and a Whippet coupe driven I by W D Grouse collided at the road intersection near the Dennis Sullivan farm in township about oclock Monday evening Mr Brokaw was was driving south and neither driv er saw the other until it was too late to avoid a collision Both cars were overturned and badly wrecked but fortunately the drivers escaped with only minor scratches and bruises Friday the three trucks em ployed on the paving cf Coming figured in an accident which resulted ia considerable damage being done
