owned and operated by Heritage Archives, Inc. ("we," "our"
or "us") and contains material which is derived in whole or in part from
Heritage Archives, Inc. and/or its subsidiaries, third party suppliers or affiliates.
Limited Use License
The Limited Use License (License) is the legal agreement between you and Heritage
Archives, Inc. and/or its subsidiaries, third party suppliers, or affiliates including,
but not limited to, all documents, images, written material, code and software (Content)
you have downloaded or received in physical or electronic format or have acquired
through a third party. Your use of any and all Content constitutes your acceptance
of this License.
You (or "your" defined by your status as an adult user and/or parent or
guardian for any minor which you allow to use the Service) may not modify, copy,
reproduce, republish, upload, post, transmit or distribute in any way any amount
of material from this site including, but not limited to, all documents, images,
written material, code and software. You may download Content from this site for
your personal, non-commercial use only, provided you abide by all copyright and
other proprietary notices and keep any and all Content intact.
All Content included in or with the Service is owned and/or copyrighted by Heritage

may only be used in accordance with this limited use license. Heritage Archives,

it is your sole responsibility to discontinue use of the Service. If you do not
agree with any of the Terms of Use contained in this document and fail to discontinue
use of the Service you will continue to be bound by the Heritage Archives, Inc.

the suitability, reliability or accuracy of the Content or services provided through
the Service for any purpose. To the fullest extent permissible by law, Heritage
Archives, Inc. and/or its subsidiaries, third party suppliers, or affiliates disclaim
all warranties, expressed or implied, including but not limited to implied warranties
of specific merchantabilities or suitability for any particular purpose, title and
non-infringement. Heritage Archives, Inc. and/or its subsidiaries, third party
suppliers or affiliates provide all Content in this Service "AS IS" and
does not warrant error-free or uninterrupted service, guarantee that flaws will
be corrected, or that the Service, server technology or any avenue of which information
is transmitted by Us to You are virus-free or without harmful components.
Under no circumstance, viable or implied, including, but not limited to, negligence,
shall Heritage Archives, Inc. and/or its subsidiaries, third party suppliers or
affiliates be liable for any direct, indirect, punitive, special or other distinctive
damages that result from the use of, or the inability to use Heritage Archives,
Inc. and/or its subsidiaries’, third party supplier’s or affiliate’s
resources. Nor are the above listed parties liable in any circumstance for loss
of profit, loss of data or any other damage in contract, tort, equity or any other
legal theory regardless of viability or implication. You (and not Us) assume the
entire cost and labor of all necessary maintenance, repair, correction or investigation
into matters mentioned above.
Heritage Archives, Inc. and/or its subsidiaries, third party suppliers or affiliates
make no warranty concerning external, third party provided goods or services that
may be presented as Content on any website, publication, and/or written or electronic
transaction. By using the Service you agree that any recourse for dissatisfaction
or problems with external, third party goods or services will be sought from the
external, third party provider and not from Heritage Archives, Inc. and/or its
subsidiaries, third party suppliers or affiliates.
Because some states/jurisdictions do not allow the exclusion or limitation of liability
for consequential or incidental damages, this limitation may not imply, in part,
to you. IF YOU ARE DISSATISFIED AT ANY TIME WITH THE SERVICE, IT IS YOUR SOLE RESPONSIBILITY
TO DISCONTINUE USE OF THE SERVICE. IF YOU ARE DISSATISFIED WITH ANY ASPECT OF THE
SERVICE AND FAIL TO DISCONTINUE USE OF THE SERVICE YOU WILL CONTINUE TO BE BOUND
BY THE HERITAGE ARCHIVES, INC. TERMS OF USE.
Image Licensing Guidelines
Heritage Archives and NewspaperARCHIVE.com can license images for corporate use
under certain restrictions. Please read the following guidelines carefully before
contacting our Media Licensing Administrator.
What can we license?
NewspaperARCHIVE.com can license most images in our database, but not all. Some
newspapers require us to withhold licensing permissions. Contact us to see whether
we can license a particular image.
Do I need to use the entire page, or can I cut out what I want?
Heritage Archives will license full-page images only.
For newspapers published prior to 1924, we allow you to manipulate the image without
further license. We will not perform the manipulation.
We cannot, for a variety of reasons, license a portion of a full page for newspapers
dated past 1923. This restriction applies to advertisements, photos, text and any
other subdivisions of a page. If you are interested in a particular piece of a newspaper
page which must be separated from the whole, please contact the newspaper publisher
directly.
Can you rescan the image at a higher resolution?
In some instances, we may be able to rescan the image at a higher resolution for
an additional cost. As we occasionally do not posses the original microfilm copy
of the newspaper, there are cases where we cannot rescan.
How do I license an image?

User Provided Material
Portions of the Service contain user provided material (Material), to which you
may contribute appropriate Material. For this Material, Heritage Microfilm, Inc.
and/or its subsidiaries are distributors only. By submitting Material, you grant
Heritage Archives, Inc. and/or its subsidiaries a limited license to use, host
and/or distribute this Material to our third-party suppliers and/or affiliates.
You agree not to contribute any copyrighted Material unless you individually and
specifically own the copyright on the Material. You remain solely responsible for
the Material you contribute, including, but not limited to, the content of your
contribution, and you agree to indemnify and hold us harmless with respect to any
claim based upon the transmission of your Materials.
Any copyright holders who find their Material available within any Content or Service
owned and/or operated by Heritage Archives, Inc. and/or its subsidiaries, third-party
suppliers or affiliates without verbal or written consent are advised to Contact Us immediately and request the removal of the
Material.
Heritage Archives, Inc. and its subsidiaries reserve the right to remove any Material
that, in our sole discretion, is believed to be illegal, obscene, indecent, defamatory,
incites racial or ethnic hatred or violates the rights of others. Heritage Archives,
Inc. and its subsidiaries reserve the right to edit any Material to promote privacy
of any kind.
Modifications to this Agreement, Service, Content and/or Materials
Heritage Archives, Inc. and its subsidiaries, in sole discretion, may change or
discontinue any or all aspects of the Agreement, Service, Content and/or Materials
at any time, without notice, including, but not limited to, access to the above
mentioned or ancillary agreements, services, content and/or materials.
Termination of Agreement
This agreement is effective until terminated by Heritage Archives, Inc. Heritage
Archives and its subsidiaries reserve the right to terminate this agreement at
any time without notice. Should you breach the agreement, Heritage Archives, Inc.
and/or its subsidiaries will revoke your License to access, use or suspend the Service
and/or any Content or Materials available.
Other
This agreement in whole or in part shall be governed by and construed in accordance
with the laws of the State of Iowa, without regard to any principles or conflicts
of law, and the Federal Law of the United States of America. If any provision of
this agreement shall be unlawful, void or for any reason unenforceable, then the
provision in question shall be deemed severable from this agreement and shall not
affect the validity and enforceability of any remaining provisions.
